Litigation costs money. The County is the plaintiff in two of the most
significant cases brought by our municipality against private defendants in the
recent history of our County. This is why this account was brought up to the
current $339,500 amount (actual expenditure in FY2009 -2010 was $237,258.33,
prior to these lawsuits being filed). Not providing the resources to properly
prosecute these actions (as well as defend the County in cases where we are
defendants) is not wise. Depositions, transcripts, and expert witnesses cost
money. Reducing the Arbitration /Mediation account is similarly dubious. The
County funds its portion of arbitrators in our labor grievances through this
account. Also, the expenditure of money and effort in seeking alternative dispute
resolution seeks to reduce the cost of unnecessary litigation.
Without this necessary funding, the County will not be properly
represented or defended in litigation.
The proposed reduction of $15,000 should not be approved.

Payment of the annual Hawaii State Bar licensing dues for our attorneys
is necessary for continued good standing before the Hawaii Supreme Court.
Our attorneys are not allowed to engage in the private practice of law outside of
their work for the County, with the limited exception of pro bono work to fulfill the
Supreme Court's aspirational requirement. The City and County of Honolulu, the
County of Maui, and the County of Kauai also fund this necessary expense,
recognizing it is a necessary requirement for the rendering of legal services to
their municipality. It is no different in private practice, where many law firms
similarly pay for this necessary expense for their partners and associates.
The proposed reduction of $7,515 should not be approved.
