'I COUNTY OF HAWAII STATE OF HAWAII • •r t1 OF 4 ,`• , RESOLUTION NO. 78 11 A RESOLUTION DIRECTING THAT THE CHIEF OF POLICE OF THE HAWAII COUNTY POLICE DEPARTMENT SHALL EQUIP EVERY PATROL AND CID OFFICER WITH A PORTABLE RADIO AND INDIVIDUAL CHARGER AND ESTABLISH A "TAKE HOME" POLICY AND APPROPRIATE RULES AND REGULATIONS FOR THE ISSUANCE, MAINTENANCE, SUPPLY, AND REPAIR OF SUCH EQUIPMENT. WHEREAS, approximately 405 Patrol and Criminal Investigation Division ( "CID ") officers ( "Officers ") share portable radios and multiple -unit chargers located at police stations within the County of Hawai`i; and WHEREAS, current policy requires that Officers return the portable radios to the police station at the end of each shift for recharging; and WHEREAS, there have been situations when an Officer returns to the station later than the scheduled end -of -shift due to an incident and an Officer beginning the next shift may not have an available portable radio, or, an Officer begins the next shift with a portable radio that may not be fully charged, or, an Officer begins the next shift with a portable radio that does not work and it is in need of repair, all of the above resulting in an Officer commencing duty without a portable radio or, without a fully charged portable radio, or, a portable radio that does not work because it needs repair; and WHEREAS, members of the Hawai`i County Police Department have expressed to some council members the need for every Officer to have a portable radio and individual charger that can be taken home by the Officer and adequately charged, and that a portable radio and individual charger be available to the Officer for use in the ordinary course of the Officer's work and work - related emergency situations; and WHEREAS, it is imperative that each Officer have at all times a portable radio, that is fully charged, and properly functioning, in order to safely and efficiently carry out their duty to preserve public peace, prevent crime, protect the rights of persons and property, enforce the laws of the State and County and quickly call for back -up, if necessary; and WHEREAS, Section 7 -2.4, Hawai`i County Charter, states, in part, as follows: "The chief of police shall be the administrative head of the police department and shall: (b) Train, equip, maintain, and supervise the force of police officers and employees. (c) Promulgate rules and regulations for the organization and administration of the police force.... "; and WHEREAS, providing every Officer with a portable radio and an individual charger is in the best interest of the public health, safety and welfare for the Officer and the public; and WHEREAS, the Hawai`i County Police Department shall establish "take home" policies and appropriate rules and regulations for the issuance, maintenance, supply and repair of the portable radio and individual charger issued to each Officer; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant to Section 7- 2.4(b), the Chief of Police of the Hawai`i County Police Department shall equip every Officer with a "take home" portable radio and an individual charger. BE IT FURTHER RESOLVED that pursuant to Section 7- 2.4(c), the Chief of Police of the Hawai`i County Police Department shall establish "take home" policies and appropriate rules and regulations for the issuance, maintenance, supply and repair of the portable radio and individual charger issued to each Officer within six months from the effective date of this resolution. 2 BE IT ALSO RESOLVED that the Hawai`i County Police Department maintain a sufficient number of spare and loaner portable radios, individual chargers, and batteries for replacement purposes in the event of damage or during repair. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the Honorable Mayor William P. Kenoi; Harry Kubojiri, Chief of Police; and Nancy Crawford, the Director of Finance. Dated at Kona, Hawai`i, this 15th day of June , 2011.
