Resolution No. 451 -06, passed by the County Council on October 16, 2006, authorized the Director of Finance to enter into negotiations for various parcels collectively known as Kawa'a or Kawa'a Bay (Kawa). On July 1, 2008, the United States Department of the Interior, Fish and Wildlife Service granted the amount of $1,000,000 for the "Kawa Bay Acquisition and Habitat Restoration Project ", also referred to as Federal Assistance Award E- 17 -RL -1 for the performance period July 1, 2008 to June 30, 2011. Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State of Hawaii Department of Land and Natural Resources, Legacy Land Conservation Commission and to accept funds for the acquisition of Kawa, District of Ka'0, Island of Hawaii. Since the funds must be encumbered by the State on or before June 30, 2011, the Department of Finance is requesting a waiver from the Finance Committee and have this resolution placed on the agenda of the next Council meeting scheduled for June 1, 2011. REQUEST: Prepare resolution authorizing the Mayor to enter into an agreement to subgrant with the State of Hawaii, Board of Land and Natural Resources, and to accept funds for the acquisition of Kawa, District of Ka'u, Island of Hawaii. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The State of Hawaii, Department of Land and Natural Resources, Division of Forestry and Wildlife applied for grant funding from the United States, Department of the Interior, Fish and Wildlife Service, Recovery Land Acquisition for the "Kawa Bay Acquisition and Habitat Restoration Project ". On July 1, 2008, Federal Assistance Award E- 17 -RL -1 for $1,000,000.00 was awarded to the County of Hawaii for acquisition of the lands at Kawa, Ka'u, Island of Hawaii for the performance period July 1, 2008 to June 30, 2011. The Board of Land and Natural Resources must encumber these funds on or before June 30, 2011. Since the Board of Land and Natural Resources needs to encumber these funds before June 30, 2011, we humbly ask that we waive the Finance committee and have the resolution heard at the Council meeting scheduled for June i 2011. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review. However, in the event this request is denied, for whatever reason, I understand the matter shall be referred to the Committee on Finance for placement on its future agenda.
