SUBJECT: Proposed Amendments to Resolution No. 82 -11; Authorizing the Mayor to Enter
into an Agreement to Subgrant with the State of Hawaii, Board of Land and
Natural Resources, and to Accept Funds for the Acquisition of Kw, District of
Ka`u, Island of Hawaii.
For your consideration, please find attached proposed amendments to Resolution No. 82 -11.
Additional information provided by the Administration required changes to this resolution. The
proposed amendments, illustrated via Ramseyer format (and bolded) with respect to the contents
of Resolution No. 82 -11, are as follows:
The fourth WHEREAS is amended to read:
"WHEREAS, on July 1, 2008, the United States, Department of the Interior, Fish and
Wildlife Service, approved the Recovery Land Acquisition grant application and granted the
amount [o€J up to $1,000,000.00 for the "Kw a Bay Acquisition and Habitat Restoration
Project" also referred to as Federal Assistance Award E- 17 -RL -1 for the performance period July
1, 2008 to June 30, 2011; and"
A draft copy of Resolution No. 82 -11, Draft 2, is attached incorporating these amendments.

RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT
TO SUBGRANT WITH THE STATE OF HAWAII, BOARD OF LAND AND NATURAL
RESOURCES, AND TO ACCEPT FUNDS FOR THE ACQUISITION OF KAWA,
DISTRICT OF KA`U, ISLAND OF HAWAII
WHEREAS, the Hawaii County Public Access, Open Space and Natural Resources
Preservation Commission cited Kawa as a site where there are "Lands or property entitlements
with high public interest, imminent needs for acquisition, and largest benefit to the general
public "; and
WHEREAS, Resolution No. 451 -06 authorizes the Director of Finance to enter into
negotiations for the acquisition of Tax Map Key parcels (3) 9 -5- 17:007, 9- 5- 17:005, 9 -5- 16:025,
and 9- 5- 16:006, comprising approximately 785.161 acres of land collectively known as Kawa
(aka Kawa'a and Kawa'a Bay), in the District of Ka`u, pursuant to Ordinance No. 05 -166; and
WHEREAS, on August 24, 2007, the State of Hawai`i, Department of Land and Natural
Resources, Division of Forestry and Wildlife, applied for funding by grant from the United
States, Department of the Interior, Fish and Wildlife Service, Recovery Land Acquisition, for the
"Kawa Bay Acquisition and Habitat Restoration Project "; and
WHEREAS, on July 1, 2008, the United States, Department of the Interior, Fish and
Wildlife Service, approved the Recovery Land Acquisition grant application and granted the
amount up to $1,000,000.00 for the "Kawa Bay Acquisition and Habitat Restoration Project"
also referred to as Federal Assistance Award E- 17 -RL -1 for the performance period July 1, 2008
to June 30, 2011; and
WHEREAS, the Board of Land and Natural Resources must encumber these funds by
appropriation on or before June 30, 2011; and
WHEREAS, pursuant to Hawaii Revised Statutes ( "HRS ") Section 46 -7, the Hawaii
County Council may consent to agreements between the County and the Federal governments
respecting action to be taken pursuant to the powers granted to the County by law and to furnish,
expend, and receive any funds or other assistance in connection with projects to be undertaken
by the County; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with HRS Section 46 -7, that the Mayor of the County of Hawai`i is authorized, on
behalf of the County, to enter into an agreement to subgrant with the State of Hawaii, Board of
Land and Natural Resources, and United States, Department of the Interior, Fish and Wildlife
Service to accept funds for the acquisition of Kawa.
