ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAII COUNTY CODE, 1983
(1995 EDITION), AS AMENDED BY ORDINANCE NO. 96-2 BY AMENDING SECTION
RELATING TO THE CREATION OF A FUND.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1: The section titled Creation of Fund in the new Article established by
Ordinance No. 96 -2 in Chapter 2 of the Hawaii County Code, 1983 (1995 EDITION) is hereby
amended as follows:
"Section 2 -_. Creation of revolving fund. Pursuant to section 10 -12 of the Hawaii
County Charter, a special revQlying fund to be known as the Geothermal [Royalty Fund]
Relocation Revolving Fund is hereby created. This fund shall be administered by the Planning
Department. Proceeds received under the section relating to funding in this article shall be
deemed reappropriated to the Geothermal Relocation Revolving Fund."
SECTION 2. Material to be deleted is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 3. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, such invalidity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provision or application, and to this end,
the provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
