AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE
1983 (1995 EDITION), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:

SECTION 1. Chapter 24, article 7, division 1, section 24-133,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-133. Stop signs described; compliance; designated.
(a) [Stop signs shall be octagonal in shape, shall have a red
background and shall carry the word "Stop" in reflectorized
white letters at least one-third the height of the sign.
Its dimensions shall be not less than twenty-four inches by
twenty-four inches.] Stop signs shall comply with the
Manual on Uniform Traffic Control Devices for Streets and
Highways as amended
(b) Except when directed to proceed by a police officer or
traffic -control signal, every driver of a vehicle
approaching a stop intersection indicated by a stop sign
shall stop before entering the crosswalk on the near side
of the intersection or, in the event there is no crosswalk,
shall stop at a clearly marked stop line, but if none, then
at the point nearest the intersecting roadway where the
driver has a view of approaching traffic on the
intersecting roadway before entering the intersection.
(c) The intersections described in schedule 12, section 24-264
are stop intersections when marked by appropriate signs
giving notice thereof.
SECTION 2. Chapter 24, article 7, division 1, section 24-135,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-135. Speed, turn lane, passing, and other [signs
described.] regulatory signs described.
[Speed limit, minimum speed, speed zone ahead, speed zone,
turn prohibition, lane use control, do not pass, pass with
care, slower traffic keep right, keep right, one way,
reversible flow, periodic one way, walk on left, do not cross,
keep off median, road closed, local traffic only, weight limit,
and all other regulatory signs shall be rectangular in shape
with black and/or red lettering on a white background.] All
regulatory signs shall comply with the Manual on Uniform
Traffic Control Devices for Streets and Highways, as amended.
SECTION 3. Chapter 24, article 7, division 1, section 24-136,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-136. Parking, bus stops, loading signs described.
[Signs governing parking, bus stops, passenger and freight
loading, etc., shall be rectangular in shape and mounted
vertically, and shall be not less than twelve inches by
eighteen inches. Prohibitive signs shall contain a red legend
not less than one and one-half inches in height on a white
background and permissive signs shall contain a green legend
not less than one and one-half inches in height on a white
background.] Signs governing parking, bus stops, loading zones,
etc., shall comply with the Manual on Uniform Traffic Control
Devices for Streets and Highways, as amended.
SECTION 4. Chapter 24, article 7, division 1, section 24-137,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-137. Yield sign described; compliance.
(a) [The yield sign shall be an equilateral triangle with one
point downward, having a black legend on a reflectorized
yellow background. The sides of the triangle shall have a
standard and minimum length of thirty inches.] The yield
sign shall comply with the Manual on Uniform Traffic
Control Devices for Streets and Highways, as amended.
(b) The driver of a vehicle approaching a yield sign, if
required for safety to stop, shall stop before entering the
crosswalk on the near side of the intersection or, in the
event there is no crosswalk, at a clearly marked stop line,
but if none, then at the point nearest the intersecting
roadway where the driver has a view of approaching traffic
on the intersecting roadway before entering the
intersection.

SECTION 5. Chapter 24, article 7, division 1, section 24-139,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-139. Warning signs described.
[(a) Advisory speed limit signs shall be square, not less
than eighteen inches by eighteen inches, with black
lettering on a yellow reflectorized background.
(b) Turn, curve, reverse turn, reverse curve, winding
road, large arrow, cross road, side road, T symbol,
Y symbol, stop ahead, yield ahead, signal ahead,
merging traffic, pavement -width transition, road
narrows, narrow bridge, divided highway, hill, bump,
dip, pavement ends, soft shoulder, slippery when wet,
school, crossings, double arrow, low clearance, and
all other warning signs shall be diamond shaped and
not less than twenty-four inches by twenty-four inches
with black lettering on a yellow background.]
All warning signs and advisory speed Plates shall comply
with the Manual on Uniform Traffic Control Devices for Streets
and Highways, as amended.
SECTION 6. Chapter 24, article 7, division 1, section 24-141,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-141. Warning signs required for livestock
movement.
(a) Any person who drives or herds any livestock across a
public highway shall place warning signs adjacent to the
public highway. [The signs shall be diamond shaped with
thirty inch sides and ninety degree interior angles, with
black lettering not less than four inches in height on a
yellow field reading "Livestock Crossing."] The signs
shall be posted immediately before and removed immediately
after the livestock cross the highway.
(b) In areas where the speed limit is more than thirty-five
miles per hour, said signs shall be posted five hundred
feet from the crossing point on each approach except when
the crossing point is clearly visible within said distance.
(c) In areas where the speed limit is thirty-five miles per
hour or less, signs shall be posted two hundred fifty feet
from the crossing point on each approach except when the
crossing point is clearly visible within this distance.

SECTION 7. Chapter 24, article 8, division 1,
section 24-189(a), of the Hawaii County Code 1983 (1995 edition), is
hereby amended by adding a new item to be appropriately designated
and to read as follows:
i� The areas described in schedule 34, section 24-286 are
designated as no stopping, standing, or Parking zone, and
appropriate signs or marking giving notice thereof shall be
erected.
SECTION 8. Chapter 24, article 8, division 1, section 24-191,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-191. Loading or unloading of passengers or
merchandise in certain areas.
(a)
Except when necessary to avoid conflict with
other traffic or in compliance with law or the
directions of a police officer or a special
traffic -control device, no person shall park a
vehicle, whether occupied or not, except
temporarily for the purpose of and while actually
engaged in loading or unloading merchandise or
passengers at any place where official signs or
markings prohibit parking.
[(b)
The areas described in schedule 36,
section 24-288 are designated as no stopping,
standing, or parking zone, and appropriate signs
or marking giving notice thereof shall be
erected.]
[(c)] (b)
No person shall move a vehicle not lawfully under
his control into any prohibited area as described
in this section or away from a curb at a distance
as is unlawful.
SECTION 9. Chapter 24, article 8, division 1, section 24-192,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-192. Parking not to obstruct traffic.
No person shall park any vehicle:
(a) On any street designated as "no parking on pavement zone"
in a manner or under such condition that any portion of the
vehicle extends over any portion of the roadway. The areas

described in schedule [279] 27 are designated as "no
parking on pavement zones" and appropriate signs or
markings giving notice thereof shall be erected, or
(b) Upon a street, other than an alley, in a manner or under
such condition as to leave available less than ten feet of
the width of the roadway for free movement of vehicular
traffic.
SECTION 10. Chapter 24, article 8, division 1, section 24-197,
of the Hawaii County Code 1983 (1995 edition), is hereby amended to
read as follows:
Section 24-197. Parking prohibited during certain hours.
(a) When official signs are erected giving notice thereof, no
person shall stop, stand or park a vehicle any longer than
is reasonably necessary to take on or discharge passengers
or freight, upon any of the streets or portions thereof
within the County, between the hours indicated on such
signs, of any day, except Sundays and public holidays.
(b) The areas of streets, described in schedule 29,
section 24-281, are designated as narking prohibited during
certain hours zones when appropriate signs or markings
giving notice thereof are erected.
SECTION 11. Chapter 24, article 10, division 1, section 24-256,
schedule 4 (30 mile per hour limit), of the Hawaii County Code 1983
(1995 edition), is hereby amended by deleting subsection (h):
[(h) State
(1) Waimea/Kohala Road (FAP Route 19), Mamalahoa
Highway to Opelo Road.]
SECTION 12. Chapter 24, article 10, division 1,
section 24-256(e), Kohala, of the Hawaii County Code 1983 (1995
edition), is hereby amended by adding a new item to be appropriately
designated and to read as follows:

Opelo Road.

SECTION 13. Chapter 24, article 10, division 6,
section 24-288, schedule 36 (freight loading zones), of the Hawaii
County Code 1983 (1995 edition), is hereby amended by deleting
subsection (g) (Puna), item (4):
[(4) Old Volcano Highway, in Keaau Village, on the Puna
side, beginning at a point four tenths mile northeast
of the volcano Road and extending forty-four feet in
the northeasterly direction towards the Keaau-Pahoa
highway.]
SECTION 14. Material to be deleted is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 15. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 16. This ordinance shall take effect upon its approval.
