After careful review of the bill as submitted by the Hawai'i County Council, a review of the Charter of the County of Hawai'i (as amended 2010), a review of previous opinions of the Office of the Corporation Counsel, and a review of prevailing case law and precedent, there are numerous legal infirmities with respect to actions taken by the Council (and actions not taken by the Council) that compromise the integrity of this bill. For this reason, we are unable to approve the bill as to form and /or legality, and cannot recommend Bill 29 (Draft 4) become law as presently submitted. Hawaii County Charter Article IV, Section 4 -1 of the County Charter of the County of Hawaii (2010 Edition) (hereinafter "Charter ") vests the executive powers of the county in, and authorizes exercise of those powers "by the executive branch, which shall be headed by. the mayor, and administered by the managing director, except as otherwise provided by this charter." More specifically, Article V, Section 5 -1.3 of the Charter provides that "the mayor shall be the chief executive officer of the county vested with all the executive powers of the county, except as otherwise provided by this charter." By contrast, Article 11I, Section 3 -1 of the Charter provides that the "legislative powers of the county shall be vested in the county council. Its primary function shall be Hawaii County is an Equal Opportunity Employer and Provider • Honorable Nancy Crawford June 14, 2011 Page 2 legislation and public policy formulation, as distinct and separate from the executive administration of county government." (Emphasis supplied). With respect to authorized Council action on the annual operating budget for the County, Article X, Section 10 -5 provides as follows (emphasis supplied): Section 10-5. Operating Budget: Council Action. After the public hearing, and after the submission of the amendments to the operating budget and to the capital budget, the county council may adopt the operating budget as amended with or without further amendments. First reading shall be after May 5. In amending, it may add new items or increase items in the operating budget. It may decrease or delete items, excepting appropriations required by law and appropriations for debt service. But in all cases the estimated revenues for the ensuing year shall be at least equal in amount to the proposed expenditures. The council shall adopt the operating budget on or before June 30. If it fails to do so, the operating budget as submitted and as amended by the mayor shall be deemed adopted by the council as the operating budget for the ensuing fiscal year. If the mayor disapproves of the bill adopting the operating budget or of any part thereof, the mayor shall return the bill or the portions vetoed with a written statement of objections to the clerk for further council action within ten calendar days of receipt of the bill. The adopted operating budget shall be in effect on and after the first day of the fiscal year to which it applies. (1974, Ord. No. 57, sec. 3; 1990, Prop. 4, sec. 1; 2010, Prop. 7, sec. 40.) Bill 29 (Draft 4) 1. The Council abdicated its responsibility under Section 10 -5 of the Charter in fabricating a "Council Adjusted Expense Account'; and failed to make decreases in items as required by the Charter. Via Council action on May 18, 2011, Bill 29 was amended to create an account entitled "Council Adjusted Expense Account ", and inserted a "negative appropriation" of $5.8 million.' The Council did not identify any items in the OCE accounts of any County department that would be reduced to offset this reduction, but instead said they would essentially "leave it to the administration to decide" or words to that effect, what to cut." Instead of identifying those programs, personnel, services or expenses that would be reduced to balance expenditures against revenues, the Council instead abdicated their responsibility and essentially mandated the Mayor perform this task. In Honorable Nancy Crawford June 14, 2011 Page 3 so creating this account and "passing" their budget, the Council has in effect violated the separation of powers and Article III of the Charter by directing the Mayor to take administrative action with respect to reductions in the operating budgets for the various County departments and agencies. In Gallagher v. Regan, 55 A.D.2d 284, 390 N.Y.S.2d 703 (1976), the Fourth Department of the New York Supreme Court's Appellate Division considered a challenge by the chief executive of Erie County against its legislature for making "lump sum" reductions in the budget submitted by the executive. The executive claimed that by not identifying specific line items to be reduced, the legislation action taken was invalid. The court agreed with the executive and held as follows (emphasis supplied): In reducing the mental health appropriations by $486,000, the Legislature has departed from the requirements of an itemized budget without persuasive justification for its action. Though the funding complexities of the mental health programs make it difficult to predict the budgetary consequences of the elimination or reduction of a particular appropriation, the programs are listed individually as line items in the tentative budget and the Legislature should have responded in kind. The legislative resolution fails to identify either the programs which should receive reduced appropriations or the amount of such reductions. Additionally, the reduction is to be accomplished by `economies in operation' without mention of the nature and scope of such economies. While the Iegislative resolution concerning this question provides that if the economies are not realized the Legislature may then make line item reductions, such a procedure contravenes its statutory duty to make a determination upon consideration of the tentative budget. The $1,240,000 legislative reduction of equipment, materials and supplies, and expense accounts is likewise invalid. This measure indiscriminately affects all county expenditures, except personnel costs" `, in every unit of county government. The Legislature has attempted to reduce the total appropriation and substitute a lump sum for these expenses in place of the itemizations contained in the budget. Such action is plainly unauthorized (Erie County Charter, s 1803) and the objection of the County Executive is valid. Accordingly, the legislative reduction of the appropriations for the accounts designated for mental health programs and for equipment, materials and supplies, and expenses may not be reflected in the budget for fiscal year 1977. Gallagher v. Regan, supra, 390 N.Y.S.2d at 709 - 710. Over the years, this office has consistently opined the doctrine of separation of powers must be strictly adhered to by both the administration and Council. In a 1988 opinion from this office (Exhibit 1), numerous proposed amendments by the Council Honorable Nancy Crawford June 14, 2011 Page 4 were deemed either violative of the Charter, Hawai'i County Code, Hawai'i State Constitution, or the doctrine of separation of powers, where the Council sought to "direct" the administration to take certain action. In that opinion, we noted that the municipal legislative body may not disregard Charter mandates or procedures at any time. An ordinance must conform to the express terms of the Charter." 5 McQuillin, Municipal Corporations, Section 15.19 (3d Ed.). Opinions from 1980 (Exhibit 2) and 1985 (Exhibit 3) are in full accord with this long- standing, well- recognized and Constitutional principle. Had the Council sought to properly pass amendments to reduce specific items in departmental OCE accounts as required by the Charter, there would be no separation of powers violation since it is wholly within the province and authority of the Council to make such amendments as contemplated in Section 10 -5 of the Charter by identifying these specific items. Had the Council identified specific departments that would be impacted by OCE reductions, and specified the amount of the reductions, their action would be arguably defensible as minimally complying with the plain reading of our Charter. See e.g., Arizona Association of Providers for Persons with Disabilities vs. State, 223 Ariz. 6, 219 P.3d 216 (2009). However this did not happen. Instead, there is serious question as to the integrity of the budget "passed" by the Council, since the underlying amendment fabricating the "Council Adjusted Expense Account" may be legally infirm as violative of the doctrine of separation of powers, as well as a plain reading of the requirements of our Charter. 2. The Council's action in reducing the annual PONC contribution by $1 million without accompanying legislation renders the reduction invalid. Via Council action on May 18, 2011, Bill 29 was amended by reducing the annual contribution of 2% of all real property tax revenues into the Public Access, Open Space and Natural Resources Preservation (hereinafter "PONC ") fund by $1 million. However, there has been no consummated Council action to amend Chapter 2, Article 42 of the Hawai'i County Code 1983 (2005 Ed.) (hereinafter "Code ") to reduce the legally mandated contribution of 2% by $1 million. Without appropriate Council action to amend the Code, contributions of less than 2% as required by law would be illegal. Unless and until Chapter 2, Article 42 of the Code is properly amended, the proposed reduction is illegal. Further validating the illegality of the Council's budget as submitted was the inexplicable inaction taken by the Council's Committee on Finance on June 14, 2011. At this meeting, despite being specifically advised by the Deputy County Clerk that an amendment to Chapter 2, Article 42 of the Code was necessary, the Committee failed to • Honorable Nancy Crawford June 14, 2011 Page 5 pass Bill 61 by a vote of 3 -6. The measure will proceed to the full Council on July 7, 2011 with a negative recommendation, well after the deadline for the enactment of the Council's version of the budget, assuming there is a mayoral veto and subsequent successful veto override." As presently submitted by the Council, their proposed budget would not enable the administration to meet its legal obligation to transfer adequate funds to the Open Space fund as currently required by law. We ask you review the enclosed Bill 29 (Draft 4) and assess the accounting implications of the bill. Our review was limited to a legal one based on what was • submitted to the Mayor by the Council. We calculate mayoral action on Bill 29 (Draft 4) must occur on or before June 16, 2011, so your prompt attention to this matter is appreciated. Very truly yours, LINCOLN S. T. (including Bill 29 (Draft 4)) ' This "negative appropriation" proposed a lump sum and unidentified reduction of $5.6 million in OCE expenditures to unidentified departments and programs, and a lump sum and unidentified reduction of $200,000 in overtime to unidentified departments. As an interesting aside, the earlier determination by the New York Supreme Court, Appellate Division that the legislature was entitled to make lump sum reductions in personnel expenses was later reversed by the Court of Appeals of New York (Gallagher v. Regan, 42 N.Y.2d 230, 366 N.E.2d 804, 397 N.Y.S.2d 714 (1977)), wherein they stated in pertinent part: "We hold that positions in Erie County government established by the County Charter and the Administrative Code cannot be abolished by the County Legislature by striking salary appropriations for such positions from the budget submitted by the County Executive." Section 10 -5 of the Charter provides in pertinent part that "The council shall adopt the operating budget on or before June 30. If it fails to do so, the operating budget as submitted and amended by the mayor shall be deemed adopted by the council as the operating budget for the ensuing fiscal year." DANTE K. Yamashiro, Chairman and Members of the Hawaii County Council 25 Aupuni Street Hilo, Hawaii 96720 Dear Chairman Yamashiro and Members: Re: Bill 543 (Draft 2) Operating Budget Atter reviewing Bill 543 (Draft 2), it is the opinion of this office that several of the amendments which were included in this draft, and which are proposed for inclusion in the budget again, are invalid, becuase they violate provisions of the Hawaii County Charter, 1980, the Hawaii County Code, and the doctrine of separation of powers. The amendments which appear in Bill 543 (Draft 2) as Sections 10, 12, 13, 14 and 15 are invalid; so is the amendment which appears in the form of Item No. 5471.45 of Bill 543 (Draft 2). Section 10 of Bill 543 (Draft 2) is invalid because it purports to authorize the Director of Finance to transfer funds with limitations out of accounts of appropriate agencies. This section states: "Transter of Funds. The Director of Finance is authorized to transfer funds out of the accounts of appropriate agencies, provided that such transfers shall not be made until all funds specifically appropriated for the stated purpose shall have been 1 EXHIBIT 1 1 • Honorable Stephen K. Yamashiro, Chairman and Members of the Hawaii County Council Page 2 June 27, 1988 encumbered; provided, however, that said transfers shall not result in the supplemented account being increased by more than 10 percent of its original appropriation without approval of the Council by adoption ot an appropriate resolution. No account from which funds are being transferred out of shall be reduced by more than 10 percent or any program eliminated by the transfer without approval of the Council." Any amount remaining in the contingency account at the close of the monthly reporting period shall be considered as funds available for supplemental appropriation by the County Council. The Director of Finance may reduce the amount of transfers to special funds." This is invalid since it conflicts with the County Charter's grant ot power to the Mayor to tranfer funds. Section 10 -9 of the Charter states: "The mayor may at any time during the fiscal year transfer part or all of any unencumbered appropriation balance between classifications of expenditures or programs within an agency or executive agency; and if at any time the mayor so requests in writing, the council, by resolution effective immediately upon adoption, may transfer part or all of any unencumbered appropriation balance from one agency or executive agency to another. But no transfer shall be made from appropriations for debt service or for estimated cash deficit; and no appropriation may be reduced below any amount required by law to be appropriated." (Emphasis added) The Charter of the city is the organic law of the corporation, being to it what the constitution is to the State, and the Charter bears the same general relation to the ordinances of the city that the constitution of the State bears to the statutes. The municipal legislative body may not disregard Charter mandates or procedures at any time. An ordinance must conform to the express terms of the Charter. 5 McQuillin, Municipal Corporations, 515.19 (3d. Ed.) Honorable Stephen K. Yamashiro, Chairman and Members of the Hawaii County Council Page 3 June 27, 1988 This is not a recent development. The opinion that such restrictions on the Mayor's power to transfer funds are contrary to the Charter has been repeated a number of times over the past years. For example, see the two enclosed opinions from this office, datea February 12, 1985 and June 12, 1980. Sections 12 and 13 of Bill 543 (Draft 2) are invalid because they attach conditions that must he met before funds that have been appropriated may be spent for that purpose. section 12 of the Budget Ordinance states: "Keahole - Kailua Development Plan. Funds proviaed for the Keahole- Kailua Development Plan shall only be used to supplement and not overlap with areas covered by the State's Kealakehe Master Plan. Copies of interim progress reports as furnished to the administration by the contractor shall be forwarded to the Council." Section 13 of the Budget Ordinance states: "Infrastructure Planning Program. A debt management program shall be included as the first phase of the Infrastructure Planning Program. The Infrastructure Implementation Plan would then comprise the second phase. Copies of interim progress reports as furnished to the administration by the contractor shall also be forwarded to the Council." This interferes with §5 -1.4 of the County Charter, which grants to the Mayor "all executive powers of the County.... ". A similar attempt to limit an executive's authority is found in Anderson v. Lamm, 579 P.2d 620 (Colo. 1978). There, the court ruled that the legislature is not permitted to interfere with the executive's power to administer appropriated funds, and that the legislature may not attach conditions to a general appropriations bill which purport to reserve to the legislature powers of close supervision that are essentially executive in character. Such a legislative encroachment on the executive exists with respect to appropriations that are conditioned upon certain reports to or approval from the legislature. Once an appropriation has been made, the legislature's work is Honorable Stephen K. Yamashiro, Chairman and Members of the Hawaii County Council Page 4 June 27, 1988 complete, and the executive's duty to administer the appropriation begins. Anderson, supra at 623. Here, Section 12 of Bill 543 (Draft 2) r eqU res that funds provided for the Keahole- Kailua Development Plan shall be used to supplement and not overlap areas covered by the State's Master Plan. It does not conaition the appropriation on an extrinsic development such as the amount of funding by the State for the Kealakehe Master Plan. Section 14 of Bill 543 (Draft 2) violates the separation of powers by requiring the approval of the Council before any private contractor may be hired for the Heeia Wasterwater Treatment Facility's operation. This section states: "Heeia Wastewater. Funds provided for the operations and maintenance of the Heeia Wastewater Treatment Facility shall be restricted to cover salaries and wages and the materials and supplies necessary to operate the plan with County employees until such tims as the arbitration regarding the operation of the plant has been resolved. No private contractors shall be hired until the County Council has had the opportunity to review the arbitration report and approved such hire." The power to contract for the'County is a power of the executive branch, of which the Mayor is the head under §4 -1, Hawaii County Charter. Council approval of contracts is only required when a contract must be paid from appropriations of a later fiscal year or of more than one fiscal year. Hawaii County Charter, 510 -11. Section 15 of Bill 543 (Draft 2) also violates the Charter's separation of powers. This section states: "Quarterly Reports. Each department or agency shall submit quarterly activity reports to the council of all monies expended." The supervision of expenditures is an executive function rather than a legislative one, and thus violates 53 -1 of the Charter, which states: Honorable Stephen K. Yamashiro, Chairman and Members of the Hawaii County Council • Page 5 June 27, 1988 "The legislative powers of the county shall be vested in the county council. Its primary function shall be legislation and public policy formulation, as distinct and separate from the executive administration of county government. [Emphasis supplied] Finally, Bill 543 (Draft 2) contained a budget appropriation to Brantley Center (Item No. 5471.45). This appropriation is invalid because it conflicts with 52 -139 of the Hawaii County Code and the Hawaii State Constitution. That section sets up procedures for the Director of Finance to select the most deserving and needed non- profit groups who apply to the County for funding. After the Director of Finance selects the groups to receive the funds, he requests appropriations from the Council. In the case of Brantley Center, its application did not meet the deadline set within the procedures for funding non - profit groups. Therefore, the Director did not request an appropriation for it. By appropriating money for the Brantley Center, the Council acted in disregard of the County ordinance and the rules and regulations set up to handle the non - profit funding. These limitations are necessary and important to comply with the constitutional requirement to assure that public money will be spent only for public purpose and in accordance with law. Matayoshi June 12, 1980 Mayor, County of Hawaii Stephen G. Bess Corporation Counsel Capital and Operating Budget Ordinances The following are my comments with respect to the subject ordinances: 1. CIP Ordinance. The last sentence of Section 5 of the ordinance is disturbing: "The Mayor shall have authority to defer projects for reconsideration la the Council whenever it is determined that the fiscal and economx condition does not warrant expenditure of the appropriated funds." (emphasis added) At minimum, this language is vague and overly broad. The language can be interpreted to mean that the Mayor may only defer projects if the Council is provided with an opportunity to reconsider the decision of the Mayor to defer. This runs afoul of the Mayor's executive powers under the charter. The Mayor's duty to implement the proposed capital budget is not merely ministerial. Rather, under the charter, the Mayor is provided with discretion to implement the proposed budget. We conclude that the proposed language of Section 5 is in violation of the separation of powers of the charter. In addition, the last sentence of Section 5 does not necessarily leave it up to the Mayor to decide whether economic and fiscal conditions warrant the deferral of a project. The last sentence states that the Mayor may defer a project when it is determined that the fiscal and economic conditions do not warrant the expenditure of the appropriated funds. It does not state that the Mayor makes this determination. Again, the language is broad enough to allow the Council to second guess or, at minimum, participate in the decision to defer a capital project. Thus, the language undercuts the authority of the executive under the charter. It should be pointed out that the above comments are not based on any explicit language found in the charter or statutes. Rather, the position is taken based upon the opinion that the charter provides for a strong executive branch and that the duty of effectuating and implementing the capital budget is not merely minimal but requires discretion on the part of the Mayor. EXHIBIT 2 • Honorable Herbert T. Matayoshi -2- June 12, 1980 2. Re: The Operating Budget We must, once again, express the same reservations we expressed last year regarding the language contained in Section 3 of the proposed operating budget. Language authorizing the Mayor to transfer funds from one account to the other and placing restrictions on the amounts which may be transferred is in violation of Section 10 -9 of the charter. Section 10 -9 provides in pertinent part: "The mayor may at any time during the fiscal year transfer part or all o any unencumbered appropriation balance between classifications of expenditures or programs within an agency or executive agency;...." (emphasis added) This language is absolutely clear in granting the Mayor unilateral authority to transfer funds between accounts within an agency or executive agency regardless of whether the transfer decreases the account the funds were transferred from by more than 10% of the original appropriation or whether the account which is supplemented is increased by more than 10% of the original appropriation. Moreover, the language contained in Section 10 -9 which immediately follows the language quoted above further supports the position that the Mayor has complete discretion to transfer funds between accounts within an agency or executive agency. Section 10 -9 goes on further to provide: "...and, if at any time the mayor so requests in writing, the council, by resolution effective immediately upon adoption, may transfer part or all of any unencumbered appropriation balance from one agency or executive agency to another." This language makes it clear that the Mayor must seek the Council's approval to transfer funds from one agency to another. The conspicuous absence of similar language with regard to the transfer of funds within an agency, underscores what is already clear- -the Mayor has unrestricted authority to transfer funds from one account to another within an agency or executive agency. The proposed budget Honorable Herbert T. Matayoshi -3- June 12, 1980 has the effect of restricting the Mayor's authority as provided by the charter. As such, Section 3 of the proposed budget is in violation of the executive power of the County Charter. Section 3 of the proposed budget goes on further to provide: No duty or program shall be transferred from one department to another without the prior approval of the County Council by adoption of appropriate resolution." To the extent that the charter provides for a duty or function to be performed by a particular department, obviously, an attempt to transfer such function or duty by the Mayor to a different department is ineffectual. However, where the Mayor wishes to transfer a duty to another department and the duty is not mandated by the charter to be performed by a particular department, the Mayor has the authority to transfer the duty or program. Clearly, the ability to transfer duties and programs is an executive function. Under Section 5-1.4 of the charter, the Mayor is vested with all of the executive powers of the County except as otherwise provided by the charter. Nevertheless, the Council does have the practical ability to restrict the Mayor's authority to transfer duties and programs from one agency to another. To the extent that the performance of the transferred duty or program requires additional funds, the Mayor must request the Council's approval to transfer funds from one agency to another (see Section 10 -9, County Charter). O'Toole, Assistant Corporation Counsel Use of Resolution in Transferring Funds. You have asked for an opinion on whether funds appropriated by ordinance for a specific purpose may be transferred by resolution to be spent on another purpose. Generally, appropriations made for a particular purpose cannot be transferred or diverted to another purpose except where otherwise provided by statute or charter. §39.69, McQuillin, Municipal Corporations. I believe that the Hawaii County Charter does provide for such a situation. Section 10 -9 of the County Charter provides as follows: "The mayor may at any time during the fiscal year transfer part or all of any unencumbered appropriation balance between classifications of expenditures or programs within an agency or executive agency; and if at any time the mayor so requests in writing, the council, by resolution effective immediately upon adoption, may transfer, part or all of any unencumbered appropriation balance from one agency or executive agency to another. But no transfer shall be made from appropriations for debt service or for estimated cash deficit; and no appropriation may be reduced below any amount required by law to be appropriated. (emphasis added) In the situation described in §10 -9 if there exists an unencumbered appropriation balance in an agency a resolution of the council would be effective to transfer the funds to another agency. No limitation is made that the funds so transferred must be used for the same purpose as originally appropriated. The charter in other situations requires that ordinances be passed to effect certain changes. Section 10 -6 requires an ordinance passed by two - thirds vote to amend the capital budget. (On the general issue of amending the operating and capital budgets, please see the attached opinion of Bruce M. Ito dated June 1, 1979.] You have also asked whether the council can appropriate funds but require the mayor to obtain council approval prior to expending those funds. I believe that such council action would be an improper restriction on the executive powers granted the mayor by charter. A previous opinion to this effect by Stephen Bess dated June 28, 1978, is attached. Section 3 -1 of the charter vests legislative powers in the County Council: "[i]ts primary function shall be legislation and public policy formulation, as distinct and separate from the executive administration of county government." The duties of executive administration for the County is given to the mayor in §5 -1.4 of the charter. The case of South Tiverton Volunteer Fire Department v. Cook, 125 A.2d 190 (1956), held that once a town council had appropriated funds for a volunteer fire company, the council could not require that it approve or authorize funds to be expended from the appropriation. In Anderson v. Lamm, 579 P.2d 620 (1978), the Supreme Court of Colorado found a violation of the separation of the legislative and executive powers in an appropriation bill which placed certain conditions on the governor's ability to expend funds appropriated. The court said: "The executive power of the state is vested in the governor, who is given the duty to see that the laws are faithfully executed. [citations omitted] In order to fulfill this duty to faithfully execute the laws, the executive has the authority to administer the funds appropriated by the legislature for programs enacted by the legislature. [citation omitted] In this situation, the Supreme Court of Nebraska has aptly observed that: 'It [the legislature] cannot administer the appropriation once it has been made. When the appropriation is made, its work is complete and the executive authority takes over to administer the appropriation to accomplish its purpose, subject to the limitations imposed.'" At p. 623 . If the Hawaii County Council attempts to limit the ability of the mayor to expend appropriated funds, they would be attempting to exercise executive rather than those legislative powers given to them by the charter. Authorization to Establish Accounts. The Director of Finance is hereby authorized and directed to open appropriate accounts for each appropriation made and set forth within this ordinance or in such greater detail as may be necessary to properly carry out the purpose of the appropriation. The Director of Finance is authorized and directed to open appropriate accounts for receipts within the various funds. Expenditures and /or encumbrances from the various accounts shall be in accordance with duly made appropriations. SECTION 6. Whenever the County of Hawaii shall receive from the United States of America, the State of Hawaii or from any public or semi - public agency, or from any private person, firm or corporation, any monies other than the normal revenues and realizations provided by law or ordinance, the Director of Finance shall submit these funds to the County Council for appropriation and after Council action by ordinance, the Director of Finance shall maintain special funds or accounts showing monies so received and specifying the purpose for which such monies have been received or for which such fund or account is being maintained shall be approved by the Director of Finance and all such receipts are herein appropriated for expenditure in accordance with the terms and conditions under which said monies shall been received by the County of Hawai'i. SECTION 7. The federal and state grant revenues set forth in SECTION in the Account Nos. 3301, 3302, 3303, 3304, 3305, and 3308 are hereby appropriated amounts and to the programs identified therein; provided that disbursement is conditioned on (1) receipt of a notification of grant award from the grantor, or receipt of notification from the grantor that the grant award will be forthcoming and that the County is authorized to incur costs pursuant to such grant award; and (2) written notice to the Council including a copy of the notification from the grantor. A final report, or the final report required by the grantor, shall be submitted to the Council upon completion of each grant program. Pursuant to Section 46 -7, Hawaii Revised Statutes, and Section 13- 13(b), Hawaii County Charter, the Mayor is hereby authorized to apply for, receive and expend the funds for the programs identified in SECTION 4. Grant revenues received during Fiscal Year 2011 -2012 for programs that are not includedin SECTION 4 shall be subject to the adoption of an ordinance appropriating such funds and shall include provisions to comply with Section 46 -7, Hawai r Revised Statutes, and Section 13- 13(b), Hawai'i County Charter. SECTION 8. The Director of Finance is hereby authorized to apply all savings realized in the 2011 -2012 fiscal year from the 2011 -2013 negotiated contracts with the State of Hawaii Organization of Police Officers, Hawaii Fire Fighters Association and United Public Works unions to Post - employment Benefits, GASB 45 Provisions account number 010.901.5902.09. • SECTION 9. Severabilitv. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 10. This ordinance shall take effect on July 1, 2011.
