Your Committee on Public Works and Parks and Recreation, to which was referred Bill 268,
Draft 2, reports as follows:
Bill 268, Draft 2, transmitted by Councilmember Pete Hoffmann, via Communication
No. 874.3, dated September 21, 2010, proposes the adoption of the 2008 National Electrical
Code .(NEC) with amendments, with the exception of the administrative portion of the code
which varies by each County. There are substantial changes to most sections.
The legislative history of Bill 268 Draft 2, is as follows:
• Originally heard by the 2008 -2010 term Committee on Public Works and
Intergovernmental Relations ( PWIRC) on August 3, 2010, and postponed to the call of
the Chair;
• On August 16, 2010, Bill 268 was waived from PWIRC to the full Council;
• On September 9, 2010, the Council amended Bill 268 to Draft 2 and then postponed
action on the Bill and related communications;
• At its March 16, 2011 meeting, the Council heard Bill 268, Draft 2 and "recommitted"
the Bill and related communications back to the Committee on Public Works and Parks
and Recreation ( PWPRC);
• On May 16, 2011, Bill 268 Draft 2, was postponed in the Public Works and Parks and
Recreation Committee ( PWPRC) until June 14, 2011.
Department of Public Works Director Warren H.W. Lee, gave a brief PowerPoint presentation at
the committee meeting informing Your Committee and the, public about the changes in the Bill
and the rational for adopting the 2008 National Electrical Code (NEC) at this time. Warren Lee
explained that when the Department of Public Works began the process of updating the County's
Electrical Code in 2007, the 2008 NEC was the most recent and that they should be allowed to
continue the current process of adopting the 2008 NEC while refining the process to make it
easier to adopt updated codes in the future. The PowerPoint presentation is numbered
Communication 126.3, and is available to the public in the County's Laserfiche system.

Councilmember Ford pointed out the fact that the codes are supposed to be updated or changed
every three years, mostly for safety reasons. Councilmember Ford asked if the County had
already adopted the 2009 International Energy Conservation Code (IECQ. DPW Building
Division Head Jai Ho Chen responded that the State must adopt the 2009 IECC first then! the
County will review, make any necessary amendments and most likely adopt it in a year or two.
For informational purposes, there were four testifiers in support of Bill 268, Draft 2.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and
intent of Bill 268, Draft 2, and recommends its. passage on first reading.
