The problem seems to be in the public eyes, one of semantics, by calling this a public road. Yes, maybe 100 years ago it was a trail or a wagon road as described at the recent hearing, but it certainly is not a road in the current sense of the word which serves the public for a public good or use. The road has been as is and gated for the past 50+ years, it was that way when all the property owners bought their properties, it is not fair to change the terms of their purchases, when the county officials told the Kanihos at the time that it was their driveway,and there was no need to bulldoze another, or of course they would have put their house further away from such "road" if it was disclosed to them at the time that that road was "public" and the gate had to stay open for public access. It makes no sense to declare this 1.5 mile, 30 foot wide stretch that the homeowners' maintain as public, thereby assuming liability for the dangerous intersection. That is an accident and liability problem for the count waiting to happen. I urge you to respect the majority of the landowners' affected by this issue. If you have concerns about actually selling, then considering leasing the road for 20 year periods, thereby reserving the "public" availability for future use.
