AN ORDINANCE AMENDING SECTION 25-8-3 (NORTH KONA ZONE MAP),
ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983
(2005 EDITION), BY CHANGING THE DISTRICT CLASSIFICATION FROM
AGRICULTURAL — ONE ACRE (A -la) AND AGRICULTURAL — FIVE ACRES (A -5a) TO
FAMILY AGRICULTURAL — ONE ACRE (FA -1 a) AT HONOKOHAU 1 ", NORTH KONA,
HAWAI`l, COVERED BY TAX MAP KEY: 7-4-026:033.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-8-3, Article 8, Chapter 25 (Zoning Code) of the Hawaii County
Code 1983 (2005 Edition), is amended to change the district classification of property described
hereinafter as follows:
The district classification of the following area situated at Honok6hau 1 st, North
Kona, Hawaii, shall be Family Agricultural One Acre (FA -1 a):
Area 1:
Beginning at a pipe in concrete at the Northeast corner of Lot 2-A-2 and this
parcel of land, being also the Northwest corner of that certain tract or parcel of land,
described as a "Tank Site", containing 1 acre of land as found in Deed from Robert
Kelshaw Greenwell to the Water Commission of the County of Hawaii recorded
January 25th, 2001, in Document No. 2001-011128, State of Hawaii, Bureau of
Conveyances. Also being at the South line of Lot 4 of "Kona Heavens Unit 1" (File Plan
1423), the coordinates of said point of beginning referred to Government Survey
Triangulation Station "MOANUTAHEA" being 17,767.61 feet South and 8,860.58 feet
West and running by azimuths measured clockwise from True South:
Thence following on the East side of this herein -described tract of land along the
remainder of R.P. 7587, L.C. Aw. 11216, Apana 36 to M. Kekauonohi (Certificate of
Boundaries No. 138), with the following three (3) courses:
348° 00' 00" 212.81 feet along said "Tank Site to a point;
2. 5' 40' 30" 465.09 feet upon and across Lot 2-A-2 to a point;
3. 6° 45' 00" 158.26 feet continuing upon and across Lot 2-A-
2 to a point in the North line of Lot
2-A-3 (TMK (3) 7-4-026:034);
4. 75' 00' 00" 468.82 feet along Lot 2-A-3, along the remainder
of R.P. 7587, L. C. Aw. 11216,
Apana 36 to M. Kekauonohi
(Certificate of Boundaries No. 138),
to a found '/2 inch rebar;
Thence following on the West side of this herein -described tract of land along the
remainder of R.P. 7587, L.C. Aw. 11216, Apana 36 to M. Kekauonohi (Certificate of
Boundaries No. 138) with the following seven (7) courses;
5. 165' 00' 00" 250.00 feet along Lot 2-A-1 of this subdivision,
to a %2 inch rebar set in concrete;
Thence along a curve to the right
with a radius of 20.00 feet, the chord
azimuth and distance being:
6. 210' 00' 00" 28.28 feet along same and Access and Utility
Easement "A-1 " to a '/2 inch rebar set
in concrete;
7. 165' 00' 00" 50.00 feet along same and upon and across
Access and Utility Easement "A-1"
to a %2 inch rebar set in concrete;
Thence along a curve to the right
with a radius of 20.00 feet, the chord
azimuth and distance being:
8. 120' 00' 00" 28.28 feet along same and Access and Utility
Easement "A-1" to a''/2 inch rebar set
in concrete;
9. 165' 00' 00" 50.00 feet along same and Access and Utility
Easement "A-1" to a''/2 inch rebar set
in concrete;

a radius of 325.00 feet, the chord
azimuth and distance being:
10. 163' 57' 15" 11.86 feet along same and Access and Utility
Easement "A-1" to a''/z inch rebar set
in concrete;
11. 162' 54' 30" 425.42 feet along same and Access and Utility
Easement "A-1" to a''/z inch rebar set
in concrete for the Northwest corner
of this herein described tract of land
and the Northeast corner of Lot 2-A-
1 of this subdivision;
12. Thence following along the Northerly side of stonewall along Lots 8, 7, 6 and 4 of
"Kona Heavens Unit 1" (File Plan
1423) for the next four (4) Courses,
the direct azimuth and distance
between Points being: 256'

marked No. 14;
13. 261" 20' 30" 223.82 feet to a pipe in concrete;
14. 234' 20' 30" 44.60 feet to a pipe in concrete;
15. 262' 43' 76.18 feet to the point of beginning and
containing an Area of 11.48 Acres,
more or less.
Beginning at a found %" iron rebar being a Southeast corner of Lot 2-A-2 and this
parcel of land, being also on the North line of Lot 19 of Kona View Estates (Phase I) as
found of record on the Hawaii County Subdivision Map No. 05-000036. The coordinates
of said point of beginning referred to Government Survey Triangulation Station
"MOANUTAHEA" being 18,281.51 feet south and 8,751.34 feet West and running by
azimuths measured clockwise from True South:
1. 75' 00' 00" 101.44 feet along said Lot 19 to a found ''/z"
rebar;

2. 185' 40' 30" 333.63 feet upon and across Lot 2-A-2 to a point
on the West line of a 1.00 acre Tank
Site;
3. 348' 00' 00" 312.57 feet along said Tank Site and Lot 5 of
Kona View Estates (Phase I) as
found of record on the Hawaii
County Subdivision Map No. 05-
000036 to the point of beginning and
containing an Area of 15,832 sq. ft.
or 0.37 of an acre, more or less.
Area 3:
Beginning at a found %2" iron rebar being the Southeast corner of Lot 2-A-2 and
this parcel of land, being also on the North line of Lot 20 of Kona View Estates (Phase I)
as found of record on the Hawaii County Subdivision Map No. 05-000036. The
coordinates of said point of beginning referred to Government Survey Triangulation
Station "MOANUTAHEA" being 18,568.56 feet South and 8,779.45 feet West and
running by azimuths measured clockwise from True South:
1. 75' 00' 00" 105.06 feet along said Lot 20 and Lot 2-A-3 of
County of Hawaii Subdivision Map
Sub -08-000788 to a point;
2. 186' 45' 00" 158.26 feet upon and across Lot 2-A-2 to a point;
3. 185' 40' 30" 131.46 feet continuing upon and across Lot 2-A-
2 to a found '/2" rebar for the
Northwest corner of Lot 19 of Kona
View Estates (Phase I);
4. 345' 00' 00" 270.00 feet along Lot 19 of Kona View Estates
(Phase I) as found of record on the
Hawaii County Subdivision Map
No. 05-000036 to the point of
beginning and containing an Area of
13,988 sq. ft. or 0.32 of an acre,
more or less.
All as shown on the map attached hereto, marked Exhibit "A" and by reference
made a part hereof.

SECTION 2. In accordance with Section 25-2-44, Hawaii County Code 1983 (2005
Edition), the County Council finds the following conditions are:
Necessary to prevent circumstances which may be adverse to the public health, safety
and welfare; or
(1) Reasonably conceived to fulfill needs directly emanating from the land use
proposed with respect to:
(A) Protection of the public from the potentially deleterious effects of
the proposed use, or
(B) Fulfillment of the need for public service demands created by the
proposed use.
SECTION 3. In the event that any portion of this ordinance is declared invalid, such
invalidity shall not affect the other parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
