Dear Ms. Goldstein:
In compliance with Condition "U" of Ordinance No. 93-109, Chalon
International of Hawau, Inc. hereby submits the annual progress report
for 1999. Condition "U" states that:
"(U) an annual progress report shall be submitted to the Planning
Director prior to the anniversary date of the change of zone. The
report shall included but not be limited to, the status of the
development and to what extent the conditions of approval are being
complied with. This condition shall remain in effect until all of the
conditions of approval have been complied with and the Planning
Director acknowledges that further reports are not required."
The anniversary date of Ordinance No. 93-109 is November 8, 1993.
Pending legal challenges had affected Chalon's ability to commit long
term financial support to the Mahukona project until the property's
entitlement status was reaffirmed. A recent ruling by the Hawaii Supreme
Court, the second of two appeals filed regarding the Mahukona resort
project, provided Chalon with a more current foundation relative to the
project's entitlement status.
On the first appeal decided by the Hawaii Supreme Court in Case No.
19051 (Civil No 93-418, Third Circuit Court), the Hawaii Supreme Court
affirmed the action by the lower court which held that 1) SMA Use Permit
No. 341 was valid, and 2) that the denial of the appellants request for a
contested case hearing on the SMA proceedings was property denied.

In the second Hawaii Supreme Court Appeal in Case No. 20723 (Civil No.
93-417), the Hawaii Supreme Court on July 13, 1999 affirmed the findings
of the lower court which held that 1) the Planning Department properly
accepted Chalon's final envirorunental impact report as constituting the
County's "eis" pursuant to Hawaii County Code Section 25-20 (c) (4); and
2) the Hawaii County Council properly approved Chalon's State Land Use
Commission boundary amendment to the Urban District for the land area
which was less than 15 acres. The court also held that the environmental
review requirement of Hawaii Revised Statutes Chapter 343 is triggered
by the proposed use of State lands (golf cart underpass across the Akoni
Pule State Highway) and remanded this finding back to the lower court for
proceedings consistent with this finding.
The net effect of the above two Hawaii Supreme Court decisions upholds
the regulatory permits and legislative approvals previously obtained by
Chalon, and only requires compliance with Chapter 343, HRS, in
conjunction with any application for the construction of the golf course
underpass across the State owned Akoni Pule Highway.
Besides ongoing grading activity for the golf course, other activities
undertaken by Chalon during this reporting period include the following:
1. Formation of a subsidiary company, Mahukona Development
Corporation, to allow financing, joint venture, and/or other
developmental strategies to be implemented for the project.
2. Contracted Tom Nance, Inc. and Blackhawk Engineering, Inc. to
ascertain and identify potable groundwater source potential.
3. Finalization of a 7-acre land sale to the Hawaii Island Community
Development Corporation for an affordable mutual self help housing
project for low and moderate income families ("Hawi Self Help
Housing Project"). Chalon received 21 affordable housing credits for
participation in this project.
4. Finalize negotiations with Parker Ranch for irrigation easements to
serve the project area.
The attached table shows the conditions that have been complied with to
date, which include those related to SMA Permit No. 341 and Use Permit
No. 111.

We do not anticipate that any time extensions for the remaining
conditions will be necessary as Chalon proceeds with the rest of the
project.
