Your Committee on Public Works and Parks and Recreation, to which was referred
Resolution No. 99-11, reports as follows:
Resolution 99-11, transmitted by Council Member K. Angel Pilago, via Communication
No. 259, dated July 6, 2011, is a resolution of determination to proceed to create and define a
water system improvement district for the Kona Ocean View properties subdivision.
After adoption of Resolution 74-11, including the findings, conclusions and recommendations
contained in the Manager's Report(Manager is the Chief Engineer, Department of Water
Supply) and carrying out the requirements set forth in Section 12-10, Hawai`i County Code for
scheduling a public hearing and notifying property owners subject to assessment and property
acquisition, the Council determines to proceed with the improvements proposed in
Resolution 74-11 and further described in the Manager's Report.
Communication No. 259.1, from County Clerk Jamae Kawauchi, dated July 6, 2011, also
discussed in your Committee today, reports that after the conclusion of the June 14, 2011
Council Public Hearing regarding the proposed improvement district, there were a total of
four(4) written protests received.
For informational purposes, four members of the public testified in Kona, in support of
Resolution 99-11. All of Your Committee members also commented in support of this
resolution.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and
intent of Resolution 99-11, and recommends its adoption.
