AN ORDINANCE AMENDING CHAPTER 5 (BUILDING CODE), OF THE HAWAII
COUNTY CODE 1983 (1995 EDITION), RELATING TO BUILDING PERMITS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 5, article 1, section 5- 1.0.16,
entitled "Amending Table No. 3 -A" and relating to Building
Permit Fees is amended by adding a new subsection to be
appropriately numbered and to read as follows:
( ). A surcharge of 25% will be added to
each building permit issued within a five -mile radius
of any newly constructed fire station for a period of
ten years following the construction of the fire
station until the construction costs of that fire
station have been recovered from the 25% surcharge,
whichever shall occur first.
SECTION 2. New material is underscored. In printing this
ordinance, the underscoring need not be included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
