Your Committee on Governmental Relations,to which was referred Bill 72,reports as follows:
Bill 72,transmitted by Councilmember Brenda Ford via Communication No. 275, dated July 13,
2011,recommends to repeal provisions for meeting notice that are no longer applicable to
special meetings and adds reference to the Hawaii Revised Statutes(HRS) for notice of regular,
special,rescheduled and emergency. The purpose is to align the County Charter with the HRS.
Ms. Ford explained that the stricken portions in the Charter, which have existed for many years,
are obsolete as this section of the Hawaii Revised Statutes has changed. This bill will bring the
Charter in line with the HRS. As a Charter amendment,this bill requires placement on the 2012
ballot.
Mr. Pilago asked for clarification of whether the emergency meeting notice requirements are
different in the Charter and the HRS. Ms. Ford explained this would put the Charter in
compliance with the requirements of HRS, and until the bill is approved, HRS would take
precedence.
Your Committee is in accord with the purpose and intent of Bill 72 and recommends it pass first
reading.
