Box 6728 Ocean View, HI 96737 808 - 990 -3992 kiguerreiro @gmail.com July 6, 2011 Chair and Members of Hawaii County Council Planning Committee 25 Aupuni St. Hilo, HI 96720 Dear Chair and Hawaii County Council Planning Committee Members; I, Karen Guerreiro, resident and land owner of Ka'u, provide testimony today in support of Councilwoman Brittany Smart's proposed Resolution 60 -11: RESOLUTION TO TEMPORARILY DELAY COUNCIL ACTION ON GENRAL PLAN AMENDMENTS AND REZONING APPLICATIONS IN THE DISTRICT OF KA'U UNTIL THE KA'U COMMUNITY DEVELOMENT PLAN I5 ADOPTED BY ORDINANCE, OR UNTIL DEC. 31, 2012, WHICHEVER SHALL OCCUR FIRST. I am gravely concerned as to WHY we need this resolution. Had we stayed the course in the development of the Ka'u CDP, we would not need this resolution. Had we stayed the course, stayed the process, and reviewed the existing draft Ka'u CDP, produced and presented to planning by our initial consultant for Ka'u CDP, PlaceMakers we could be celebrating a completed Ka'u CDP or at least nearing adoption of Ka'u CDP. But instead we are stuck with delay after delay after delay. The first in the series of many delays was the outline for the draft Ka'u CDP. PlaceMakers designed an outline for the Ka'u CDP, submitted it to the county for approval, Ron Whitmore disapproved. Ron had designed an outline for the Ka'u CDP that was 5 x's bigger than PlaceMakers' outline. After much discussion between PlaceMakers and Ron, PlaceMakers had to concede all outline designs to Ron. Per Howard Blackson of PlaceMakers, "Ron won." Next delay was PlaceMakers' preferred draft Ka'u CDP. The preferred draft, drafted by PlaceMakers utilizing Ron's 5x's larger outline and submitted to Ron and county planning department, was the first of three planned drafts, each being presented to the stakeholders, the county, the Steering Committee and Ka'u community -a process designed to tailor make the Ka'u CDP to and for Ka'u. PlaceMakers drafted the preferred draft Ka'u CDP with the focus and direction: "Doing less is more....Fixing what we have....and to not change 180 degrees to urbanization." As it turned out, Ron did not like this focus and direction. Did Ron discuss this with anyone? Comm. No. ' ( 3 . U 1 Ref. To: f /PC Ref. Date L 6.... I ask who saw this draft that was produced timely by PlaceMakers? It was not the stakeholders, not the Steering Committee, not the community of Ka'u, nor the current consultants. Not only that, PlaceMakers waited forever for Ron Whitmore to contact them for revision, comments, edits, rewrites, PlaceMakers literally waited forever, for Ron Whitmore never contacted PlaceMakers for rewrite, revision, edits. Howard Blackson never received feedback on the preferred draft. As if these grave DELAYS weren't enough....Ron fires /terminates our contract with PlaceMakers. Fires PlaceMakers, our consultants and author of our Ka'u CDP, fires them over a draft. A working draft. The PlaceMaker team worked for 18 months, 2 years on the Ka'u CDP, prepares our first of three drafts, working draft. All that work.... Ron won't share, won't utilize as a draft, as the framework for our Ka'u CDP. Instead, his decision leads of course to more lengthy delays, more and more lengthy delays. Delays in finding candidates, potential new lead consultants, delays in screening, interviewing, and choosing new lead consultants, and then more lengthy delays to go through the lengthy county procurement processes in order to pay these new consultants....more lengthy delays after more lengthy delays. A two year project is now four years and more. We have spent years to get nowhere we need to progress forward. Now after we have buried our Ka'u CDP with delay after delay after delay; we have layers of conflict of interest to deal with. First conflict: Ron prepared the outline for the Ka'u CDP, not PlaceMakers. Second conflict: Ron is now writing the new, his new Draft Ka'u CDP. Why is Ron writing this new preferred draft? Why rewrite what we have. Why not just review, edit, modify and change as needed the current preferred draft Ka'u CDP. We bought it, we own it, and there is some really good stuff in it. What doesn't Ron understand about DRAFT? Draft as in working document designed to be reviewed, edited, revised. PlaceMakers provided us with a working draft why can't we work on it? Third conflict of interest: Ron's choice of consultants PBR Hawaii to replace PlaceMakers. They, PBR Hawaii, are Nani Kahuku Aina, LLC's consultant for their proposed new town Kahuku Village, here in Ka'u. I am not the only person to question this conflict of interest having PBR Hawaii work simultaneously for our Ka'u CDP and Nani Kahuku Aina, LLC's consultants for their proposed new town Kahuku Village, here in Ka'u. Below are several occasions this question has arisen and the answers only add to the confusion and reinforce the multiple levels of conflict of interest. 1. Email dated Wednesday, September 16, 2009 - between Ron Whitmore, to hawaiiesparza(aol.com, and cc to Roy Takemoto of PBR Hawaii and Howard Blackson of PlaceMakers. (See Attachment A pg 1): a. It's important to understand that Roy Takemoto is not the lead planner for Nani Kahuku Aina. Tom Witten, PBR's principal, is. doing the EIS. Therefore, Nani Kahuku Aina is not Roy's vision — it's the vision of the Peroff family and their partners. Katherine Peroff or Aaron Eberhardt would be the appropriate people to share the project vision with the public, which they've been doing. It's my understanding that Roy's role is limited to 2 b. Roy will not be an author of the CDP. Roy's role with the CDP is limited to doing objective data /information gathering and mapping for the community profile. He is not doing any analysis, and he won't be involved in the planning, other than to help with some economic mappings. (Please clarify Roy Takemoto' greatly expanding role with the our Ka'u CDP, after he has worked so hard on the new proposed town Kahuku Village) 2. On November 18, 2009 Ka'u CDP Steering Committee adopted a list of objectives for the community and CDP. On page 14 (See Attachment B pg 2) is a request to "Clarify PBR's role with Hawaii County and proposed new town Kahuku Villages Resort"? (We are still waiting clarification) 3. On Tuesday, February 9, 2010, at the Ka'u CDP Steering Committee meeting, this conflict of interest, (see attachment C pg 2) was raised by Charles Flaherty regarding the potential conflict of interest for PBR Hawai'i, since they are developing the new town Kahuku Villages EIS and serving as a consultant to the CDP. Ron Whitmore explained "that, from the get -go, the County has been transparent about PBR Hawaii's potential conflict of interest and the County's efforts to avoid conflicts of interest by limiting PBR Hawaii's role with the CDP to gathering objective data for the Community Profile. " (Now they are lead consultants and coauthors) 4. Fast forward to Councilwoman Brittany Smart's district 6 Matter Meeting June 9, 2011, I attended and asked is this not a grave conflict of interest between PBR Hawaii working on both projects, our Ka'u CDP and Nani Kahuku Aina, LLC's proposed new town Kahuku Villages, Ron Whitmore response was "not at all, we're utilizing Roy Takemoto out of the Hilo office, and he's a great guy and will do great work. Nani Kahuku Aina, LLC is utilizing PBR's Honolulu office, hence no relationship, separate offices, separate islands." 5. The question do we want a new town in Ka'u has not been answered. How is PBR Hawaii not going to try to influence the outcome of the Ka'u CDP's question "do we need a new town in Ka'u ?" They (PBR) only benefit with a yes answer. If this question was answered with "No, Ka'u does not need a new town," then PBR Hawaii's work with Nani Kahuku Aina, LLC's proposed new town Kahuku Village is out. They would be ending their own job. Hahahaha! I find that hard to swallow! I find they are in a supreme position, a stronger position then me to influence the outcome of that question. I address you today, Hawaii County Council Planning Committee; we are way behind schedule with avoidable delays. Had we stayed the course of the development of our Ka'u CDP, we would not be extending a two year project to four plus years. Ron has seemed to over step his role in drafting both the outline and now is now author of the Ka'u CDP, not reviewer, not stakeholder. 3 We have the obvious conflict of interest with PBR Hawaii's role in projects, Nani Kahuku Aina, LLC's proposed new town, Kahuku Village; and as the county's lead consultants and coauthor for our Ka'u CDP. You now have evidence; Roy Takemoto of PBR Hawaii is /has been very much involved in both projects. Although Ron assures us there is no conflict of interest, the same PBR Hawaii boss oversees both offices and gets reports from both projects and Roy has worked and reported on both projects. Is this not a grave conflict of interest. PlaceMakers' director Howard Blackson would love to share his draft Ka'u CDP with all of Ka'u. He states, "There is good stuff in there." No, Howard does not want to resume work with the county. Howard loves Hawaii, he has worked here in the past: He worked at Punaluu years ago in the '80's hence ideal candidate to help get Punaluu back to its glory, after college he worked with, did intern work with, PRB Hawaii and recently as director of PlaceMakers, he and his team worked on Kona's new Civic Center, Kona CDP as well as our Ka'u CDP. Howard loves Ka'u, he calls it "the last great wonder in the state Hawaii." He states, "Ka'u has great potential," and hopes "Ka'u keeps its character for the next generation." Howard loves Ka'u's majestic natural beauty, wonders, breathtaking scenery, historical and cultural significance and its rich endless shoreline. With good planning, all these features can be enjoyed now and for future generations. Hence for the people of Ka'u, after Great Delays and Great Conflict of Interest, I beg, I implore the council to: 1. Adopt Councilwoman Brittany Smart's Resolution 60 -11, guarantee us, the residence, the community of Ka'u, the ability to complete the Ka'u CDP, without large developers i.e., Nani Kahuku Aina, LLC, to utilize this delay in our Ka'u CDP development and adoption as a means to squeeze in ahead of the Ka'u CDP. 2. I beg, plead, the Hawaii County Council to advise us in Ka'u how to correct this grave conflict of interest: the use of PBR Hawaii as lead consultant and coauthor of our Ka'u CDP while they are consultant for the proposed new town Kahuku Villages, especially changing consultants leads to new delays, eliminating them leads to to narrow of a perspective for the draft Ka'u CDP we are really messed up. 3. I beg for us in Ka'u to be allowed to utilize Pacemaker's draft Ka'u CDP, Howard Blackson has offered it freely. Let the Steering Committee review the document then bring this existing draft Ka'u CDP before the community, let us the community of Ka'u work on it. You contributed significantly to setting a very positive tone and for gathering some great information. Mahalo! During the Summit and on several other occasions since the news of the Nani Kahuku Aina development broke last week, we've received questions regarding the proposal for 16,000 acres in Ocean View. Our strategy, Councilmember Guy Enriques affirmed during a meeting last week (he's also getting lots of questins about the project), has been to include the project in our Charrette studies to test its merits and get public input on the proposed General Plan amendments. Therefore, if people approach you about the project, please encourage them to participate in the charrette. To make sure we're all on the same page, we thought it would be useful to forward you my response below to common questions that people are asking. Please help us communicate accurate information about the project and how it interfaces with the CDP process. As always, let me know if you have any questions. And like all stakeholders. they've been invited to participate in the charrette. They've agreed to do that and to wait to complete the draft EIS until after the charrette. 4) ft is not the Steering Committee's role to consider individual developments (or to do any planning, for that matter). The purpose of the very public summits and charrette is to involve all stakeholders in the key planning exercises. Nani Kahuku Aina's plans will be part of at least one altemative development scenario that is considered during the charrette, so, as you suggest, everyone will be able to help evaluate whether the proposed General Plan amendments are appropriate from a regional planning perspective. 5) Keep in mind that the General Plan amendment being requested by Nani Kahuku Aina is the first in a long series of land use and other entitlements that they will have to get before the project is a go. They have not yet, as misreported in the Ka u Calendar, applied for rezoning. That is a long ways off. Therefore, the timing of their GP amendment petition and the CDP couldn't be better — it gives the community the opportunity to consider the hawaiicountycdp .info /... /attachment.htm 1/3 cd .info/ A44-CA ch,.y��,, �� 3j25/2011 www,hawaiicoun ty P prpermail/ka... appropriateness of changes in the GP that such a large deaelopment would require at exactly the time when the community is considering how to tailor the GP's goals, policies, and actions for Ka'u. Nani Kahuku Aina's petition to amend the GP won't be complete until the EIS is finalized. which is scheduled for March /April. Once the petition is complete, the Planning Director has 120 days to review it and either reject it or initiate the amendment. If the amendment is initiated, it then goes to the Planning Commission, which has 60 days to hold a public hearing and 30 days from there to submit its recommendations to the County Council. The Council then takes it up, holds its own hearings, etc. The CDP is scheduled to be completed in April, and if all goes well, it will be adopted by the fall. Since the CDP will speak to future land uses throughout the district, including the greater Ocean View area, it will provide critical guidance to the Planning Director, the Planning Commission, and the Council. I believe that the Ka'u community would like to learn about Roy Takemoto's vision for Ka'u since he is writing the EIS for this resort development and will also be an author of the Ka'u CDP. I would suggest that along with all the maps that were displayed at the last summit we have a display of the plans for this resort and Kahuku Villages representatives (including Roy) available to answer questions. Roy Takemoto should be able to provide the maps.. I look forward to your reply. Comments shall be limited to three (3) minutes per person. APPROVAL OF MINUTES: The Steering Committee will consider the draft minutes of the November 18 and December 8, 2009 meetings. BUSINESS 1. Project Update: Ron Whitmore, County planner and Ka`u CDP project manager, will provide a brief update on the development of the first draft of the CDP. Hawaii County is an Equal Opportunity Provider and Employer the Planning Department for the CDP process eliminated funding for the Community Planning Assistant, the Recorder, and supplies and miscellaneous expenses. He also described the roles of the Community Planning Assistant and Recorder and indicated that both these positions were integral to the continued smooth functioning of the CDP process. It was moved by Ron Ebert and seconded by Donna Ambrose that the Steering Committee Chair and Ron Whitmore collaborate on a response to the Puna CDP Action Committee supporting the request for continued funding of the CDP Steering and Action Committee budgets for all communities at their current level, with copies of the memo sent to the mayor and Council as well as other CDP committees. The motion carried unanimously. PUBLIC COMMENTS ON AGENDA ITEMS Ralph Roland questioned what all this process is costing the district. He feels that implementation will be costly and that the community can do without spending all this money. He feels that planning is still in an archaic stage and that the world is changing so fast that the County needs to come up to speed before spending this kind of money. Charles Flaherty had a number of comments and suggestions for the Steering Committee. He distributed a study entitled `A Review of Coastal Monitoring Data for Development in West Hawaii' commissioned by the County of Hawaii Planning Department. He pointed out that the results indicated that near shore development in West Hawai `i may result in environmental degradation. He also pointed out that the Kona Steering Committee didn't allow any specific developer to come forward until the CDP process was completed. He encouraged the Steering Committee members to look at the General Plan related to `Historic Sites', specifically with regard to protecting Hawaiian rights and Hawaiian culture. Finally, he suggested that Councilman Guy Enriques could introduce legislation to have the CDP budget restored. Charles also raised questions :: t the potential conflict of interest for PBR Hawai`i, since they are both developing the Kah . _es EIS and serving as a consultant to the CDP. Ron Whitmore explained that, from - get -go, the County has been transparent about PBR Hawai`i's potential conflict of interest and the County's efforts to avoid conflicts of interest by limiting PBR Hawai`i's role with the CDP to gathering objective data for the Community Profile. Millie May commented that there seems to be very little follow up to questions that are raised by the public at the Steering Committee meetings. She referenced questions about the budget for PlaceMakers and the timelines that they are supposed to adhere to. Ron Whitmore responded that the budget for PlaceMakers is tracked conscientiously but that it is not posted online. As with other public records, members of the public can make a written request to the Planning Department for information about project budgets. With respect to timelines, he advised that specific timelines were in place leading up to the Charrette because lots of public input was being solicited. However, no future meetings are going to be scheduled or timelines established until the first draft of the CDP is complete. 5 HOWARD BLACKSON QUALIFICATIONS Howard advocates time - tested planning strategies that have proven to add value to communities — one neighborhood, one block, and one building at a time. He looks beyond conventional short -term horizons, and works in service of creating the legal parameters key to the creation of attractive, cohesive, and economically successful mixed -use environments.
