HomeMy WebLinkAboutRES 123 Draft 01 2010-2012COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 123 11 A RESOLUTION APPROVING FOR INCLUSION IN THE 2012 HAWAII STATE ASSOCIATION OF COUNTIES' LEGISLATIVE PACKAGE REQUESTING THE LEGISLATURE OF THE STATE OF HAWAII REMOVE THE CEILING ON THE COUNTIES' SHARE OF THE TRANSIENT ACCOMMODATION TAX. WHEREAS, the transient accommodations tax is a tax levied by the State of Hawai`i on the proceeds derived from furnishing transient accommodations; and WHEREAS, Act 185, Session Laws of Hawai`i 1990, gave the counties a share of the transient accommodations tax; and WHEREAS, according to Conference Committee Report No. 207 (1990), the purpose of Act 185 was to provide a more equitable method of sharing state revenues with the counties, rather than continuing with the system that existed at the time whereby the counties requested financial assistance through grants -in -aid from the State; and WHEREAS, 44.8% of the total transient accommodations tax collected by the State is distributed to the counties and allocated as follows: Kaua`i County Hawai`i County City and County of Honolulu Maui County 14.5% 18.6% (FY 12 Op. Budget - $17,298,000) 44.1% 22.8% 100.0 %; and WHEREAS, on June 9, 2011, the governor signed into law Act 103 which imposed a ceiling of $93,000,000 on the amount of transient accommodation tax funds transferred to the counties from July 1, 2011 through June 30, 2015; and WHEREAS, the counties' share of the tax also provides more stability to county finances and enables improved budgeting and planning; and WHEREAS, the transient accommodations tax provides for needed revenues for the operations of county government to improve the quality of life of our residents and enhance visitor satisfaction; and WHEREAS, the transient accommodations tax amount received by the County of Hawai`i in fiscal year 2011 prior to the implementation of the ceiling was $19,153,617; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it approves for inclusion in the 2012 Hawai`i State Association of Counties' legislative package requesting the Legislature of the State of Hawai`i to remove the ceiling on the counties' share of the transient accommodations tax. BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed to transmit copies of this Resolution to the Honorable Mayor William P. Kenoi, and to the Hawai`i State Association of Counties' Executive Committee. Dated at Kona , Hawai`i, this 21st day of September , 2011.
