TESTIMONY in support of Bill No. 27
Relating to Noisy Dog; Procedure for Abatement of Nuisance
The Office of the Prosecuting Attorney for Hawaii County supports Bill No. 27 which
removes the requirement of the police waiting for an hour for the owner of a dog to abate the
dogs barking before the owner can be cited.
For the several years our office has received several complaints from community
members about neighbors with barking dogs. Our office has also had referrals from Council
members, the Mayor's office, the police department and other agencies to help find solutions for
this problem.
The current wording of the ordinance makes enforcement very difficult and according to
one district court judge, would require the police officers to wait the hour before citing the owner
of a noisy dog. With limited resources, it is not practical to have an officer wait around for an
hour for dogs to stop barking in order to give a $25 citation.
This bill is a common sense approach to making this ordinance enforceable.
The Office of the Prosecuting Attorney respectfully requests passage of Bill 27.
