Your Committee on Public Works and Parks and Recreation, to which was referred Resolution
No. 150-11, reports as follows:
Resolution 150-11, transmitted via Communication No. 358, from Assistant Corporation
Counsel Katherine Garson, dated September 8, 2011, authorizes the acquisition of private
property by eminent domain, tax map key: (3) 7-7-008-114 (portion), situated at Pahoehoe 2nd,
District of North Kona, County and State of Hawai`i, for the La'aloa Avenue extension project.
The area of land to be acquired is approximately 2.710 acres for the La'aloa Avenue Extension
Project.
Section 101-13 of the Hawai`i Revised Statutes requires that a condemnation action by the
County must be authorized by a resolution of the County Council.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and
intent of Resolution 150-11, and recommends its adoption.
