Your Committee on Public Works and Parks and Recreation, to which was referred Resolution
No. 153-11, reports as follows:
Resolution No. 153-11, transmitted via Communication No. 362, from Assistant Corporation
Counsel Katherine Garson, dated September 8, 2011, accepts a grant of easement and bill of sale
for sewer facilities for Ali`i Heights Subdivision, Unit 1, Phases I thru III, district of North Kona,
Island of Hawai`i, State of Hawai`i, from Towne Keauhou LLC.
Towne Keauhou LLC is desirous of granting these easements and sewer facilities located in the
Ali`i Heights Subdivision, including all pipelines, equipment, structures and other related
facilities, to the County of Hawai`i. The facilities have been inspected by applicable agencies
and are found to be in acceptable condition.
Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the Council may accept
gifts, or donations of money, securities, or other personal property or of real estate or any interest
in real estate on behalf of the County of Hawai`i.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and
intent of Resolution 153-11, and recommends its adoption.
