Hawai `i County is an Equal Opportunity Provider and Employer BRAmendHiloZoneMap- HalelokeStreet.doc-8 /02/11 COUNTY OF HAWAII PLANNING DEPARTMENT BACKGROUND AND RECOMMENDATION INITIATOR: PLANNING DIRECTOR AMENDMENT TO CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983 (2005 EDITION) REGARDING THE CITY OF HILO ZONE MAP The Planning Director is initiating an amendment to Section 25 -8 -33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2005 Edition) by relocating the proposed 60 -foot wide right-of-way connecting `Akolea Road and `I`iwipolena Road to the north to align with Haleloke Street in the vicinity of Hilo Heights Subdivision, accompanied by the adjustment of adjoining roadways at Ponohawai, South Hilo, Hawai`i, TMK: 2 -5 -08: por. 24; 2 -5 -15: por. 12 thru 18 & 92; 2 -5 -56: por. 1 thru 12; 2 -5 -58: por. 01 and 4 thru 20; and 2 -5 -60: por. 07, 08, 51, 53, 59 thru 61 and 68. PURPOSE 1. Amendment of the City of Hilo Zone Map to relocate the existing 60 -foot wide future road right -of -way between `Akolea Road and `I`iwipolena Road as shown on the City of Hilo Zone Map to the north to coincide with the alignment of Haleloke Street within Hilo Heights Subdivision. (see attached Exhibits 1, 2 and 3) 2. This current 60 -foot wide future road right -of -way, as shown on the City of Hilo Zone Map, straddles the common boundary between Hilo Heights Subdivision and `Akolea Plantation Subdivision, affecting those lots that adjoin this common boundary. The Planning Director is recommending the elimination of this 60 -foot wide future road right of way in favor of designating the existing Haleloke Street and its future extension to serve as the collector ATTACH: Comm . 367 Bill 99 a roadway connecting `Akolea Road and `I`iwipalena Road. The alignment of Haleloke Street parallels the alignment of the proposed 60 -foot wide future road right -of -way. JUSTIFICATION FOR REQUEST 3. If both collector roadways were to be built, they will be separated by only 330 feet, or roughly the length of one lot within Hilo Heights Subdivision. The Planning Director does not believe that having two collector roadways in such close proximity to one another will promote a functional roadway network within this part of the City of Hilo. 4. Access to the existing 37 -lot Hilo Heights Subdivision -Unit I is provided by Haleloke Street, a 60 -foot wide roadway that has sufficient width to serve as a collector roadway. The original master plan for the proposed 180 -lot Hilo Heights Subdivision project, that was never fully implemented beyond the existing 37 lots in Unit I, clearly showed the extension of Haleloke Street to the extension of `I`iwipolena Road. The 38 -lot Punahoa Mauka Subdivision located immediately makai of Hilo Heights Subdivision was approved in August 2010 and further extended Haleloke Street to a point just shy of `I`iwipolena Road. This subdivision and the extension of Haleloke Street has not yet been completed. 5. Looking at existing and future roadway circulation patterns as depicted on the City of Hilo Zone Map, it would be the Planning Director's preference that the proposed 60 -foot wide collector roadway shown on the City of Hilo Zone Map and located on the common boundaries of Hilo Heights and `Akolea Plantation subdivisions be eliminated in favor of designating the existing Haleloke Street and its future extension as the future connector roadway between Ainako Road and `I`iwipolena Road. This would resolve the need for the County to condemn the back yards of over 63 lots within the Hilo Heights, Punahoa Mauka, -2- Akolea Plantation and other adjoining subdivisions to provide for a future roadway that will be functionally replaced by the extension of Haleloke Street. 6. Until such time the City of Hilo Zone Map is amended, the Planning Department must continue to apply minimum yard setbacks along the future width lines of the 60 -foot wide collector roadway. Since this future roadway straddles lots within several adjoining subdivisions, each affected parcels must accommodate a 30 -foot wide share of the future roadway, plus the application of the standard 20 or 30 -foot wide minimum rear yard setback when planning a home or other structure upon these properties. Most other homes within these subdivisions unaffected by this future roadway typically accommodate a 20 or 30 -foot wide rear yard setback. If the County has no intention of pursuing the construction of this future 60 -foot wide collector roadway, it would be unfair to all of these affected landowners to continue to accommodate future road width lines and setbacks for a roadway that will never get built. RECOMMENDATION For the reasons cited above, the Planning Director recommends that the Planning Commission send a favorable recommendation to the Hawaii County Council for an amendment to Section 25 -8 -33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2005 Edition) by relocating the proposed 60 -foot wide right -of- way connecting ` Akolea Road and `I`iwipolena Road to the north to align with Haleloke Street, accompanied by the adjustment of adjoining roadways. KERN: Okay, next item on the agenda was originally Item No. 4, Planning Director initiated, and now that would be Agenda No. 9, amendment to Chapter 25, Article 8, Section 25 -8 -33 of the Hawai`i County Code. And I'll let Daryn give us the breakdown of what that is. Thank you. ARAI: Thank you, Mr. Chairman. Good morning, Commissioners. The purpose of the amendment that's currently before you is to amend the City of Hilo Zone Map to basically relocate a proposed 60 -foot wide right - of -way that straddles the subdivisions of Hilo Heights and Akolea Plantation. Those two subdivisions are located in the Kaumana area, I'm sorry, between Kaumana and Pi`ihonua off of Akolea Road. And, again, the purpose of this amendment is to basically relocate that proposed roadway as shown on the zoned district map and place it in alignment with the existing Haleloke Street that is currently situated within Hilo Heights Subdivision. The reason for this request is three - pronged. Basically if both collector roadways were to be built, you'll have two collector roadways, which is roughly 60 -feet wide within 330 feet of each other. And, obviously, that does not make sense. And when 1 show you the location maps and diagrams further into this presentation you'll get a clearer sense of why we have this concern. Having those two collector roadways in such close proximity just simply does not promote or enhance our functional roadway network within this part of Hilo. Approval of this amendment will need, require the County to basically condemn the back yards of 63 lots within both of these subdivisions as well as other adjoining subdivision. And if the County has no intention of pursuing the construction of this roadway, then it would be unfair that the roadways continue to accommodate the proposed roadway with setbacks and additional right -of -ways. Again, this is a location map with Hilo Bay here, this white little area. The project area is located in this vicinity here. Akolea Road being this road running north /south connecting to Wailuku Drive in Pi`ihonua; and in this 1 direction here is Kaiimana Drive. Halekoke, I'm sorry, Hilo Heights Subdivision is this subdivision in this area here. Again, this is a close -up, Akolea Road being to the left of this map. Iwipolena Street which goes and connects to Kaumana Drive down here is this roadway here which would eventually be extended to connect to Ainako Drive, Ainako Avenue, I'm sorry. Haleloke Street within Hilo Heights Subdivision is partially constructed and it comes down and it terminates in this location here. The proposed existing 60 -foot wide right -of -way as shown on the Hilo Zone Map is in this vicinity here indicated by this dash line. The intent of that proposed roadway was to connect Akolea Road with Iwipolena Street, which would then be connected to Ainako and provide for this interior type of circulation. But as you can see within 330feet is the existing Haleloke Street, with a proposed subdivision that was recently approved and if constructed would provide for a further extension of Halekoke Street, running just shy of Iwipolena Street. So the function of Haleloke would then serve to replace this proposed roadway shown on the Hilo Zone Map. Again, this is just a copy of the maps showing all of the proposed amendments. What we're having here is moving the existing 60 -foot wide right -of -way to the north to match Halekole Street, so Haleloke would replace that 60 -foot wide proposal, as well as some minor adjustments. There were other roadways in the area that connects to, that were supposed to connect to this right -of -way. Because we're moving it to the north and because all of the lots have already been subdivided, there's going to be a disjoint. So we're basically eliminating the joints. There may be a need in the future upon further investigation to maybe get rid of these future connector roadways that goes to and connects to Kaumana Drive, the extension of Iwipolea Street and Akala Road; but that is something that we'll investigate in the future; and we may bring it before you for consideration. So at this point we ask for your favorable reconsideration of this request. KERN: Any questions for staff? Seeing none, there is nobody signed up from the public to testify on this.
