In addition, Corporation counsel Lincoln Ashida states that they have broken the law. They have a chance to correct both issues on June 24 at 9 a.m. in Hilo with teleconferencing in Kona and Waimea. Please testify or send an email to counciltestimony@co .hawaii.hi.us and ask the County Council to honor their pledges to voters and reinstate the 2 percent Land Fund. In October 2010, before the last election, council members Fred Blas, Pete Hoffmann. Brittany Smart, Brenda Ford and Dominic Yagong signed a pledge that said, "I pledge to honor the voters of Hawaii County who voted for the 2 percent Land Fund ordinance in 2006 to deposit 2 percent of our property taxes in an open space fund. I will support resuming the deposits to the 2 percent Open Space Fund in 2011 and 1 will make sure that deposits are not suspended again" Candidate Pilago's wife, Nita, sent an email stating: "Check my track record. I have 'always' supported the 2 percent land fund and any fund to protect our aina. I stand on my track record and my integrity. You can add my name to the support list, but I feel there is no need to sign your pledge — Angel." To see these signed pledges go to dhecht.com. These pledges were intended to reduce public testimony time at budget hearings on the 2 percent issue. According to a Sierra Club executive committee member, "In the last election, Sierra Club endorsed Ford, Hoffmann, Pilago, Smart and Yagong, based in part on their statements of support for full funding of the 2 percent open space fund. Several even said they'd introduce a charter amendment for 2 percent." It is important to have the 2 percent amount deposited in the land fund because the land fund is working. There is currently $3.5 million in the fund. By cutting the fund by $1 million, the county is actually losing 52 million in dollar- for - dollar matching fund potential. There are three properties currently under negotiations that may not be acquired if the land fund is not funded at 2 percent. This will reduce the credibility of the county if these negotiations fall apart because of lack of funds. Kawa Bay (Ka'u) will use 51.4 million of land fund money to meet matching funds from the State Legacy Lands Fund and funds from U.S. Fish and Wildlife for the endangered hawksbill turtle. Kaiholena south is actively listed for sale (appraised at $4.5 million); there are matching funds of 51.65 million from the State Legacy Lands Fund. The Kingman Trust property in Kona is appraised at $3.2 million but has no matching funds. Pohoiki Bay (Puna) was just approved by the council for acquisition. By reducing the land fund by 51 million we could lose the Kingman Trust property, Kaiholena and Pohoiki Bay. There are two laws that govern the percentage of property taxes that are to be placed in the land fund. The first law is in the Hawaii County Code. In 2006, citizens collected almost 10,000 signatures by petition initiative to get the .2 percent Land Fund ordinance on the ballot, which was approved by 57 percent of voters. The second law is part of the Hawaii County Charter. In 2010, The Save our Lands Citizens Committee submitted a 2 percent Land Fund charter amendment to the charter commission (appointed by the mayor). The commission placed a 1 percent land fund charter amendment on the ballot, which was approved again by 57 percent of voters. A charter amendment may only be changed by a vote of the people, so the land fund must receive at least 1 percent of our property taxes each year. This charter amendment was brought forward because of the political wrangling during 2009 budget hearings, endless testimony by more than 100 supporters of the 2 percent Land Fund, which resulted in suspension of deposits to the land fund for two years by amending the code. Mayor Kenoi promised to suspend deposits for only 2 years. Deposits were set to resume at the full 2 percent amount as of July 1, 2011. We thank Kenoi for keeping his promise by reinstating the full 2 percent amount in the 2011 -2012 budget. Council members Blas, Hoffmann, Smart, Pilago and Yagong voted to cut the deposits to the land fund. Ford was the only council member who voted against cutting deposits to the land fund. Thank you council member Ford for honoring your pledge. Next in the process will be the June 24 special council meeting where the County Council will hear Bill 63 -- reducing the Land Fund deposits to 1 percent of our property taxes. According to the letter from the mayor, he has vetoed the budget, in part, because Corporation Counsel Lincoln Ashida has said the council has illegally cut the land fund by not obeying the county code. The administration asked Councilman Donald Ikeda to introduce a measure to cut the deposits by changing the county code, which is Bill 62. This was voted down in the Finance Committee, 6 -3. We ask County Council members Blas, Smart, Hoffmann, Yagong and Pilago to respect their constituents, live with integrity and honor their pledges to support a 2 percent Land Fund. If they vote together, they can override the mayor's veto and reinstate the land fund deposits at 2 percent of our property taxes as was originally in the budget. Please email the council at counciltestimony @co.hawaii.hi.us and ask them to honor their pledges and reinstate the 2 percent amount. Yes, this is about saving the lands that make the Big Island one of the most uniquely beautiful places in the world. On a more important, big picture level, this issue is about trusting that our elected officials will represent us with integrity and believing they will honor us by fulfilling their promises. WE will be assured that 2% of our property taxes will be deposited each year at budget time. Remember the Mayor and Council suspended deposits to the fund from 2009 to 2o 11, which meant we did not have $8 million (or $16 million with dollar for dollar matching funds) to acquire land during that time. 2. Because.. Charter amendments can only be changed by a vote of the people. 57.5% of us voted YES twice in 2006 and 2010 to have the Land Fund, but the budget "wrangling" has continued. 3. Remember 2% of our property taxes is approximately $4 million per year. The great "gift" of the land fund is to acquire matching funds. To date, the county has spent $11,297,000. for four properties and only obtained $2.145 in matching funds. 4. There are still MANY properties our communities want to acquire — see the list compiled from the Public Access and Open Space Commission's recommended List of properties sent to the Mayor further down in this article. 5. With a 2% charter amendment in place we won't waste citizens time in going to council meetings during budget hearings to testify AND we won't waste council member's time having to listen to testimony. The county's suspending deposits to the fund for two years (2009 -2100) really slowed down the acquisition program. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Article X, Financial Procedures, Section 10 -15, of the Hawai'i County Charter (2010 Edition), relating to the Public Access, Open Space, and Natural Resources Preservation Fund, is amended to read as follows: Section 10 -15. Public Access, Open Space, and Natural Resources Preservation Fund. a) In adopting each fiscal year' s operating budget [and capital program], the council shall appropriate a minimum of [ene}.two percent of the certified real property tax revenues, including penalty and interest, to a fund known as the public access, open space, and natural resources preservation fund. Deposits to the fund shall occur at a minimum, on a quarterly basis. b) Funding shall consist of a minimum of [one] two percent of actual revenue received in the fiscal year. Additional revenue may consist of grants and private contributions intended for the purpose of this section, voluntary contributions of any amount as specified on the real property tax bill, proceeds from the sale of general obligation bonds authorized and issued for the purpose of this section, council appropriations for the purpose of this section, [and grants and private contributions intended for the purpose of this section,] and any other source of revenue. c) Monies in this fund shall be used solely to: 1) Purchase or otherwise acquire lands [or property entitlement:] and easements in the County of Hawaii for public outdoor recreation and education, including: A) Access to beaches and mountains; B) Preservation of historic or culturally important land areas and sites; C) Protection of natural resources, significant habitat or eco- systems, including buffer zones; D) Protection of watershed lands to preserve water quality and water supply. (2) Pay the principal, interest and premium, if any, due with respect to bonds issued in whole for the purpose of this fund. d) Any balance remaining in the fund at the end of any fiscal year shall not lapse, but shall remain in the fund accumulating interest from year to year. The moneys in this fund shall not be used for any purpose except those listed in this section. e) The council shall by ordinance establish procedures for the administration and expenditure of moneys in this fund. f) This fund shall be used for acquisition of land and easements and shall not be used for development. maintenance or for any purpose other than as provided in this section. g) The highest and best use=of_Ihis fund is to leverage the money in the fund by attracting matt- hing- funds.although, matching funds are not required in every purchase. h) Any land acquired with this fund shall contain the following restrictive covenant in its recorded deed of conveyance: " This land was acquired with moneys from the Public Access. It shall be held in perpetuity for the use and enjoyment of the people of Hawai' i County and may not be sold, mortgaged, traded or transferred in any way." SECTION 2. Charter material to be repealed is bracketed and stricken. New charter material is underscored. When revising, compiling, or printing these charter provisions for inclusion in the Charter of the County of Hawai' i, the reviser need not include the brackets, bracketed material, or underscoring. SECTION 3. If any provision of this ordinance, or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance, which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are severable. SECTION 4. Upon adoption of this ordinance, this council, by appropriate resolution, Shall provide that this amendment be submitted to the electorate of Hawaii County for approval in the 2012 general election. SECTION 5. The charter amendment proposed in this ordinance shall take effect upon its approval by a majority of voters voting on this legislation in the 2012 General Election, as duly certified. Notwithstanding the provisions of subsection (a), proration of the deposits affected by this legislation shall begin on November 7, 2012.
