The second "BE IT FURTHER RESOLVED" clause is amended to read as follows: "BE IT FURTHER RESOLVED that the Department of Public Works and /or Planning Department shall submit a complete streets progress report [as part of the Hawai`i County General Plan annual report.] to the County Council within six months of the adoption of this resolution." No. 390?• 5 Ref. To: Ref. Dote JJCr 9 (l l A RESOLUTION SUPPORTING THE ESTABLISHMENT OF A COMPLETE STREETS POLICY FOR THE COUNTY OF HAWAII. WHEREAS, complete streets are roadways designed, constructed, and maintained to enable safe, efficient, comfortable, and economical mobility and access for all users, including pedestrians, bicyclists, motorists, and transit riders of all ages and abilities; and WHEREAS, complete streets policies promote non - motorized travel as alternatives, thus helping to reduce traffic congestion, greenhouse emissions, and personal transportation costs incurred by rising fuel prices; and WHEREAS, complete streets policies help to develop a connected and complete transportation network that reduce hazards and improve safety for all users, including those unable to operate a motor vehicle, such as young children, the elderly, and the physically disabled; and WHEREAS, according to the National Complete Streets Coalition, as of August 2011, 284 jurisdictions have adopted complete streets policies or made written commitments to do so; and WHEREAS, HRS, section 264 -20.5 (2009) requires the State of Hawai`i and Hawai`i County to adopt a complete streets policy that seeks to reasonably accommodate convenient access and mobility for all users of the public highways within their respective jurisdictions as described under HRS, section 264 -1, including pedestrians, bicyclists, transit users, motorists, and persons of all ages and abilities; and WHEREAS, HRS, section 264 -20.5 (2009), this complete streets policy shall apply to new construction, reconstruction, and maintenance of highways, roads, streets, ways, and lanes located within urban, suburban, and rural areas, if appropriate for the application of complete streets; and WHEREAS, HRS, section 264 -20.5 (2009) shall not apply if: "1. Use of a particular highway, road, street, way, or lane by bicyclists or pedestrians is prohibited by law, including within interstate highway corridors; 2. The costs would be excessively disproportionate to the need or probable use of the particular highway, road, street, way, or lane; 3. There exists a sparseness of population, or there exists other available means, or similar factors indicating an absence of a future need; or 4. The safety of vehicular, pedestrian, or bicycle traffic may be placed at unacceptable risk." ; and WHEREAS, subsections 13.1.3(c), (d), (e), and (f) of the County of Hawai`i General Plan provide the following transportation policies: "(c) The improvement of transportation service shall be encouraged. (d) Consider the provision of adequate transportation systems to enhance the economic viability of a given area. (e) Develop a comprehensive, islandwide multi -modal transportation plan that identifies the location and operation of automobile, mass transit, bicycle and pedestrian systems, in coordination with appropriate Federal and State agencies. (f) Work with various non - profit agencies to coordinate transportation opportunities." ; and WHEREAS, section 13.4.3 of the County of Hawai`i General Plan provides the following mass transit policies: "(a) Improve the integration of transportation and land use planning in order to optimize the use, efficiency, and accessibility of existing and proposed mass transportation systems. (b) Support and encourage the development of alternative modes of transportation, such as enhanced bus services and bicycle paths. (c) Incorporate, where appropriate, bicycle routes, lanes, and paths within road rights - of -way in conformance with The Bikeway Plan for the County of Hawaii. (d) Provisions to enhance the mobility of minors, non - licensed adults, low - income, elderly, and people with disabilities shall be made." ; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it supports the establishment of a Hawai`i County complete streets policy. BE IT FURTHER RESOLVED that the County of Hawai`i Department of Public Works and Planning Department are encouraged to continue working with the State of Hawai`i and various community organizations to ensure the completion and implementation of a complete streets policy for the County of Hawai`i. BE IT FURTHER RESOLVED that the Department of Public Works and /or Planning Department shall submit a complete streets progress report to the County Council within six months of the adoption of this resolution. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the Honorable Mayor William P. Kenoi, the Director of the Department of Public Works, the Planning Director, and Executive Director Laura Dierenfield of the Peoples Advocacy for Trails Hawai`i (PATH).
