Enclosed is a bill for an ordinance adding the Ka'u High — Pahala Elementary gym & CD
Shelter project for $17,900,000 to the Capital Budget. These state funds are authorized
by the Governor of Hawaii pursuant to Act 160, SLH 2009, Item K11.02 as amended by
Act 180, SLH 2010 for the design and construction of a new gymnasium /civil defense
shelter on the ground of Ka'u High and Pahala Elementary School.
Time is of the essence to expedite the project. To this end, the Department of Public
Works is requesting to waive the Finance Committee review, and have this bill placed on
the October 19, 2011 Council meeting agenda.

A. REQUEST:
An ordinance amending Ordinance 11 -60, The Capital Budget, by adding the appropriation:
Ka'0 High - Pahala Elementary Gym & CD Shelter (State) $17,900,000.00
State Grants Receivable $17,900,000.00
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Pursuant to Act 160, SLH 2009, Item K11.02, as amended by Act 180, SLH 2010, the Governor
authorizes the use of State Funds for the design and construction of a new gymnasium /civil defense
shelter on the ground of Ka`u High and Pahala Elementary School.
We are requesting an appropriation in the Capital Projects Fund to account for the reimbursable
expenditures. Funding source will be State Grants Receivable.
Please waive this Ordinance from the Committee on Finance so that it will proceed for Council's
approval.

RE: Bill No. 125 : A Bill for an Ordinance amending Ordinance No. 11 -60,
as amended, Relating to Public Improvements and Financing Thereof for the
Fiscal Year July 1, 2011 to June 30, 2012; adding the Ka'u High — Pahala
Elementary gym & CD Shelter project for $17,900,000 to the Capital Budget
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above - referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
