Re: Comm. No. 373/Res. No. 160 -11
Your Committee on Finance, to which was referred Resolution No. 160 -11, reports as follows:
Resolution No. 160 -11, transmitted jointly with Bill No. 103 by Finance Director Nancy
Crawford via Communication No. 373, dated September 22, 2011, authorizes the Mayor to enter
into an agreement with the State of Hawaii Department of Health, Alcohol and Drug Abuse
Division (ADAD).
The State of Hawaii Department of Health, Alcohol and Drug Abuse Division (ADAD), is
providing funds for the purpose of supporting the Police's efforts to conduct enforcement
operations of minors purchasing tobacco. The Hawai`i Police Department will conduct a
minimum of six enforcement operations by plainclothes officers to observe purchase attempts by
minors and to cite any retail store which makes an illegal sale to a minor.
Pursuant to Section 46 -7, Hawai`i Revised Statutes, County Departments must obtain the consent
of the Council to enter into agreements with the federal or state governments respecting action to
be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds
or other assistance in connection with projects being or to be undertaken pursuant to those
powers.
Lieutenant Lucille Melemai, Juvenile Aid Section in Hilo appeared before Your Committee.
Lieutenant Melemai commented that Department of Health selects the sites in this operation, and
she believes that an average of 4 to 6 locations will be carried out during each operation.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 160 -11,
and recommends its adoption.
