Your Committee on Planning, to which was referred Bill No. 101, reports as follows:
Bill No. 101, transmitted by Mayor William P. Kenoi, via Communication No. 369 dated
September 8, 2011, is an ordinance amending the Puna Community Development Plan, as
adopted by the Ordinance No 80 -116 and amended, by Ordinance No, 10 -104, relating to
formatting and clerical revisions.
At the October 4, 2011 Planning Committee, County of Hawai`i Planner Larry Brown and Puna
Community Development Plan Action Committee (PCDP -AC) Chair Dan Taylor were present
and stated that Bill No.101 addresses clerical and formatting errors in the Puna Community
Development Plan (PCDP).
Several Council Members had concerns that the amendments in Bill 101 were substantive. They
stated that in Section 3.5.3c. 3) parts (4) and (6) the word "develop" was not a strong enough
verb and that "build" or "construct" would be more appropriate. They also stated concerns with
Section 3.1.3h of the Implementation Table and the definition of the word "fix ". Other concerns
were the addition of "in the coastal zone" in Section 2.4.3b of the Implementation Table and
they felt the deletion of Section 4.2.3e and added language to Section 4.2.3b.3 regarding express
bus service for commuters from Pahoa to Hilo and Volcano to Hilo might also constitute a
substantive change to the PCDP.
Bill No. 101 was postponed with 8 ayes and 0 noes until the October 18 Planning Committee
meeting to allow the PCDP -AC time to review and make comments on the amendments.
At the October 18, 2011 Planning Committee, Council Member Yoshimoto confirmed all
members had Communication 369.1 and asked Larry Brown and Dan Taylor to come forward.
Deputy Corporation Counsel Julie Mecklenburg was also present for questions.
Mr. Brown stated the PCDP -AC met on October 11; 2011 to address the items of concern that
the Council Members raised at the October 4, 2011 Planning Committee meeting. Their
response is contained in Communication 369.1. The Action Committee states that they do not
consider these substantive changes and they support them as they bring clarity to the PCDP.
