RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI -YEAR CONTRACT
FOR SERVICES OF COLLECTION AND HAULING OF RECYCLABLES AT ISLAND -
WIDE SOLID WASTE RECYCLE AND TRANSFER STATIONS.
WHEREAS, Section 10 -11 of the County Charter requires that any contract, lease or
other obligation requiring payment of funds from the appropriations of a later fiscal year or more
than one fiscal year be approved by resolution; and
WHEREAS, in order to conserve our resources, the recycling of glass, cardboard,
newspaper, mixed papers, plastics, scrap metals, and organic waste is preferable to landfilling;
and
WHEREAS, in order to divert recyclable materials from the landfill, a convenient 2 -Bin
Recycling Program was implemented in 2007 providing recycling bins for residents at county
transfer stations; and
WHEREAS, the 2008 Integrated Resources and Solid Waste Management Plan
(IRSWMP) identified recycling and waste diversion as major activities to help the County reach
its recycling goals, and
WHEREAS, Resolution 356 -07, A Resolution to Embrace and Adopt the Principles of
Zero Waste as a Long -Term Goal for Hawaii County was approved by Council on December 19,
2007; and
WHEREAS, landfill waste disposal capacity (air space) is finite. The South Hilo
Sanitary Landfill projected to reach maximum capacity at current activity levels within six (6) to
eight (8) years. The West Hawai'i Sanitary Landfill has more available air space at this time, but
it will also reach capacity at some point in the future; and
WHEREAS, landfills are expensive to operate, maintain and close. Landfills must
comply with strict Department of Health (DOH) requirements while in operation and must be
monitored for at least 30 years after they are closed. The establishment of a new landfill is
controversial and takes many years to develop; and
WHEREAS, efficient, safe, and lawful collection and hauling services requires capital
investment; and
WHEREAS, the high capital investment for equipment and operations start-up costs,
estimated at $1,000,000, require a multi -year commitment to recoup costs and secure reasonable
terms for equipment financing. A multi -year commitment also provides the county the most
favorable opportunity for competitive bids; and
WHEREAS, the county's current contract for these services expires June 30, 2011 and
finds it in their best interest to continue to contract for private services at an average unit price
not to exceed $190 per ton for the collection and hauling of recyclables with a three (3) year
agreement, with (2) two twelve (12) month option periods to extend contracted services; and
WHEREAS, the County is finalizing an Invitation for Bid (IFB) "INVITATION FOR
BIDS AND SPECIFICATIONS FOR PRICE AGREEMENT FOR COLLECTION OF
RECYCLABLE MATERIALS FROM SOLID WASTE CONVENIENCE CENTERS
(TRANSFER STATIONS) FOR THE DEPARTMENT OF ENVIRONMENTAL
MANAGEMENT "; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Article X, Section 10 -11 of the Hawai`i County Charter, the Mayor is hereby
authorized to enter into a multi -year contract for services of recycling collections and hauling
from island -wide solid waste transfer stations and that sufficient funds be budgeted in future
fiscal years to cover the anticipated obligation of the County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the Mayor, the Director of Environmental Management and the Director of Finance.
