Your Committee on Planning, to which was referred Bill No. 9, transmitted by Mayor
Stephen K. Yamashiro per Communication No. 25, dated December 8, 1998, regarding the change of
zone request by Amy S. Yamamoto, at Waiakea, South Hilo, Hawaii, TMK: 2-4-11:87, reports as
follows:
Although transmitted by the Mayor in December 1998, Bill No. 9 was not agendized until March 5,
1999, when it was deferred until today. Your Committee decided to defer all zoning requests until the
status of the infamous Bill No. 250 and all of its drafts, otherwise known as the Zoning Code, was
known. Bill No. 250, Drafts 4 and 9 (ramseyered) will be heard by the Hawaii County Council on its
first reading on March 17, 1999, and on its second and final reading on April 6, 1999. Bill No. 9 will
advance to the Council for its first reading on Apri16, 1999.
Bill No. 9 amends Section 25-8-33 (City of Hilo Zone Map) Article 8, Chapter 25 (Zoning Code) of the
Hawaii County Code, by changing the district classification for approximately 21,780 square feet of land
from a Single Family Residential (RS-IS) to a Single Family Residential (RS-10) zoned district.
The rectangular-shaped property, owned in fee by the applicant, is located on the west side of Naniakea
Street near the dead-end towards the Hilo Municipal Golf Course, approximately 1,500 feet south of its
intersection with Kawailani Street. The applicant would like to subdivide the property into two lots, each
consisting of approximately 10,890 square feet in size, in order to construct another dwelling to the rear
of the existing dwelling. There is an existing 44-year old single family dwelling on the property
consisting of approximately 2,324 square feet with a 600 square foot attached carport.
Although a home occupation permit for a pest control operation was granted on May 24, 1984, the
business was not established.
The State Land Use District classification for the subject property is "Urban". The proposed
development would be consistent with the goals, policies, standards and courses of action of the Land
Use Element. The General Plan LUPAG Map classifies it as Low Density Urban Development. The
ALISH classification is existing urban development.
The Hilo Community Development Plan recommends the area for RS-15 zoning, and the County zoning
is also Single Family Residential (RS-15).
The U.S.D.A. Soil Type is OID, Olaa extremely stony silty clay loam. The surface layer is very dark
brown extremely stony silty clay loam about 16 inches thick. The soil dehydrates irreversibly into
gravel-size aggregates. Permeability is rapid, runoff is slow and the erosion hazard is slight. The soil is
used to grow sugarcane. The Land Study Bureau's Detailed Soil Classification System is "U" or Urban.

The subject pazcel is in Zone "X" which is outside the 500-year flood plain.
The likelihood of any endangered flora and fauna or azchaeological features are remote since the subject
property has been developed.
Lands adjacent to and across the subject property are approximately 20,000 square feet in size, zoned
RS-15 and in single family residential uses. The Hilo Municipal Golf Course is located approximately
200 feet to the south of the subject property and also abuts the property to the rear. There have been
three rezonings in the area (1981, 1990 and 1994).
Access to the property is from Kawailani Street to Naniakea Street, adead-end road with no future
extension plans. The subject property fronts Naniakea Street, a County road with an approximate 10-foot
wide pavement in fair to good condition, with grass shoulders, all within an approximate 40-foot
right-of--way. The remaining pavement leading up to Kawailani Street is approximately 12 to 16 feet
wide.
All essential utilities and services aze available to the subject property. Water is provided by an existing
6-inch waterline that fronts the subject property. According to the Department of Health, the subject
property is located in the Critical Wastewater Disposal Area where cesspools are not allowed and
subdivisions on this lot would require all existing cesspools to be upgraded to a septic system.
Bill No. 9, Draft 2, which included the fair share contributions, was not approved by Your Committee
because of the age and location of the residence. Being that it is an older, well-established neighborhood
with all necessary improvements, it is unnecessary to collect the fair shaze contributions. Although the
applicant confirmed that there are no plans to build any other structures on the subject parcel, after
further discussion, Your Committee agreed to insert the language which prohibits the construction of a
second dwelling unit on each lot in Condition E.
For informational purposes only, on the final vote, Committee Members Curtis Tyler and Julie Jacobson
voted "Kanalua" twice.
Your Committee concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the change of zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 9, Draft 2, as amended
to Draft 3, and recommends it pass first reading.
