Dear Chairman Arakaki and Members of the County Council:
SUBJECT: Resolution Authorizing Use of Prior Yeaz Funds
Attached is a resolution authorizing the appropriation and use of funds originally
appropriated in the fiscal year ended June 30, 1996. At June 30, 1996, these funds were
encumbered in a contract to purchase personal computer equipment, softwaze, and
various peripherals for several different departments. Unfortunately, the contractor has
defaulted on the contract and will not be able to supply any of the necessary items, so the
contract has been canceled. Since these funds were appropriated in a prior yeaz, they
cannot now be utilized without the Council's authorization.
The computer equipment included in the canceled contract is part of ongoing projects
such as the applicant tracking system for the Department of Civil Service. The
equipment is needed as soon as possible, and to enter into a new contract with the second
lowest bidder, the Council's approval of this resolution is needed. Therefore, we request
that the attached resolution be waived from the Committee on Finance and placed on the
agenda of the next County Council meeting.

RE: Resolution Authorizing Use of Prior Year Funds
Pursuant to Section 1(d) of Rule 4 of the Rules of Procedure of
the Council of the County of Hawaii, this written approval is
submitted in regards to Resolution No. 12 authorizing the
appropriation and use of prior year funds resulting from the
cancellation of a contract, waiving said referral from the
Committee on Finance in order that appropriate action can be taken
by the Council.
In reviewing the contents of the referral, it is deemed advisable
that such waiver be granted.
