AN ORDINANCE AMENDING CHAPTER 14, GENERAL WELFARE, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO AXIS DEER BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. Axis deer directly compete with cattle and other live stock for food. They eat cash crops and native vegetation, and if unregulated, could devastate the Big Island agricultural industry. This ordinance is a preemptive attempt to quell the negative effect that axis deer have in our county by prohibiting the transportation and harboring of axis deer. This ordinance will take effect ninety days after its approval. SECTION 2. Chapter 14, Hawai`i County. Code 1983 (2005 Edition, as amended), is amended by adding a new article to be appropriately designated and to read as follows: "Article . Regulation of Axis Deer. Section 14 -_. Transporting live axis deer into the County; unlawful. It is a violation of this article for any person to transport live axis deer into the County. Section 14 -_. Transporting live axis deer within the County; unlawful. It is a violation of this article for any person to transport live axis deer within the County. Section 14 -_. Harboring axis deer; unlawful. It is violation of this article for a person to give shelter or refuge to axis deer on private property. Section 14 -_. Exemptions. The Pana` ewa Rainforest Zoo is exempt from this article. Section 14 -_. Penalty. Any person who violates this article shall, upon conviction thereof, be guilty of a misdemeanor, and be sentenced to a fine of up to $2,000, or imprisonment for a period of up to one year, or both." SECTION 3. Severability. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this ordinance without the invalid provisions or applications, and to this end, the invalidity or applications provisions of this ordinance are declared to be severable.
