Re: Request for Executive Session relating to Amendment of Resolution No. 34 -11''
This letter is to provide additional information regarding our request for our amendment
to Resolution 34 -11 to be discussed in Executive Session.
I would like to clarify that because there is an active procurement in process, and
award has not been made, this information is not yet public record per HRS Section
103D- 303(d) — "shall be open for public inspection after contract award ". Also, in
accordance with HRS Section 103D- 303(f), "in conducting discussions, there shall be
no disclosure of any information derived from proposals submitted by competing
offerors."
So in accordance with HRS Section 92- 5(a)(8), "to deliberate or make a decision upon
a matter that requires the consideration of information that must be kept confidential
pursuant to a state or federal law, or a court order ", we request that this action be
discussed in Executive Session.
