Sako Deputy Director Enclosed is a resolution to amend Resolution No. 34 -11 which authorizes payment of funds of a later fiscal year and of a multi -year contract for organic waste diversion and compost operations in West Hawaii and East Hawaii. The current contract extension for greenwaste operations expires on 12/31/11 and is planned to be extended until 6/30/12 to allow time to award a new contract and allow for start -up time. The Department of Environmental Management (DEM), through the Finance Department, has issued a Request for Proposals to expand organic waste diversion and establish compost operations at the South and West Hawaii Sanitary Landfills. Resolution No. 34 -11 authorizes the Mayor to enter in to a multi -year contract for this purpose. However, the resolution contains language that impedes the full evaluation of proposals considering all criteria as required under HRS § 103D -303. The Department of Environmental Management requests that the estimates of "high equipment and operations and start up costs, which are between $1,500,000 and $2,000,000" and the contract limitation "at an estimated price per ton not to exceed an annual average of $70" be deleted. Due to the pending evaluation of proposals, the Department of Environmental Management requests that this resolution be waived from the Finance Committee, and be placed on the December 21, 2011 Council agenda. Additionally, because there is an active procurement in process, they request that this resolution be heard in Executive Session. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review.
