RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR CONTRACT
FOR SERVICES OF HAULING OF RECYCLABLE MATERIALS AT ISLAND -WIDE
SOLID WASTE RECYCLE AND TRANSFER STATIONS.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or
other obligation requiring payment of funds from the appropriations of a later fiscal year or more
than one fiscal year be approved by resolution; and
WHEREAS, in order to conserve our resources, the recycling of materials including
glass, cardboard, newspaper, mixed papers, plastics, and scrap metals is preferable to landfilling;
and
WHEREAS, in order to divert recyclable materials from the landfill, a convenient 2-13in
Recycling Program was implemented in 2007 providing recycling bins for residents at county
recycling and transfer stations; and
WHEREAS, the 2008 Integrated Resources and Solid Waste Management Plan
(IRSWMP) identified recycling and waste diversion as major activities to help the County reach
its recycling goals, and
WHEREAS, Resolution 356-07, A Resolution to Embrace and Adopt the Principles of
Zero Waste as a Long -Term Goal for Hawai `i County was approved by Council on December
19, 2007; and
WHEREAS, the hauler will incur capital investment for collection bins (to be placed at
recycling and transfer stations) and trucks to haul the collection bins; and
WHEREAS, the hauler is expected to handle the recyclable materials responsibly and
lawfully by delivering the recyclable materials to a "permitted facility" (owned or other)
confirmed by the State Department of Health; and
WHEREAS, the "permitted facility" will assume the responsibility of sorting, baling,
marketing and shipping the recyclable materials to an accepting facility that will recycle the
materials into same or different products; and
WHEREAS, the "permitted facility" may be eligible for payment (excluding HI -5 glass
and plastic) from the County's Landfill Diversion Incentive Program and from the State Glass
Advance Disposal Fee (ADF) Grant; and
WHEREAS, the Landfill Diversion Incentive Program is designed to encourage
recycling and to supplement the "permitted facility's" cost during commodity value fluctuations;
and
WHEREAS, the Diversion Payment amount is based on the direction of the commodity
value fluctuations; and
WHEREAS, the capital investment for equipment and operational start-up costs
(estimated at $1,000,000) favor a multi-year commitment to recoup costs and secure reasonable
terms for equipment financing. From the County's standpoint, a multi-year commitment affords
the opportunity for cost competitive bids; and
WHEREAS, the County's current contract option years ended June 30, 2011; the 1" 180 -
day extension expires December 31, 2011; and a 2nd 180 -day extension to June 30, 2012 is in
progress to be effective until said time or until a new contract is awarded, whichever comes first;
and
WHEREAS, the County is finalizing an Invitation for Bid (IFB) "INVITATION FOR
BIDS AND SPECIFICATIONS FOR PRICE AGREEMENT FOR HAULING OF
RECYCLABLE MATERIALS FROM SOLID WASTE RECYCLE AND CONVENIENCE
CENTERS (TRANSFER STATIONS) FOR THE DEPARTMENT OF ENVIRONMENTAL
MANAGEMENT"; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Article X, Section 10-11 of the Hawaii County Charter, the Mayor is hereby
authorized to enter into a three (3) year contract with two (2) twelve (12) month option periods to
extend services for hauling of recyclable materials from island -wide solid waste recycle and
transfer stations and that sufficient funds be budgeted in future fiscal years to cover the
anticipated obligation of the County under the terms of the contract.
BE IT FURTHER RESOLVED that the contract shall be bid with a minimum of two
(2) geographic zones for the twenty-one (21) transfer stations to maximize competition and
assure that all communities will be provided access to the 2 -Bin recycling services.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to (1) the Honorable William P. Kenoi, Mayor of the County of Hawaii; (2) the
Director of Environmental Management; and (3) the Director of Finance.
