Enclosed is a bill for an ordinance amending several sections of Chapter 21, Article 5, of
the Hawaii County Code 1983 (2005 Edition, as amended), relating to the Sewer
Connection Loan Program. The program has not been utilized since its establishment. In
preparing for its possible use for property owners connecting to a new sewer system in
Honoka`a, it became apparent that certain sections required some modification to improve
the program and meet certain grant requirements.
The purpose of this ordinance is to amend certain sections within the chapter to: insure
competitive loan rates; provide applicants with adequate time to complete applications;
eliminate the option of the County hiring contractors to work on private hook -ups on
private property; remove an unnecessary loan option; manage taxpayer funds responsibly
by providing some loan guarantee parameters; meet the requirements of the state grant
to assist certain property owners; make it more consistent with other programs in the
County Code; and make other incidental improvements.
Council Chair Yagong has introduced Bill 146 that also is related to the Sewer Connection
Loan program; and at the December 6th Finance Committee Meeting, his bill was
recommended for passage on 1st reading and will be heard at the next Council meeting
scheduled for December 21, 2011. Since our proposed bill is related to the same Chapter
21 as Bill 146, we are requesting a waiver from the Finance Committee so that both bills
can be discussed concurrently at the December 21st Council meeting.

RE: Bill No. 159 : A Bill For An Ordinance Amending Chapter 21, Article
5, Various Sections of the Hawai`i County Code 1983 (2005 Edition), Relating to
Sewer Connection Loan Program
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above - referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
