Your Committee on Planning, to which was referred Communication No. 211 transmitted by
Mayor Stephen K. Yamashiro dated Mazch 24, 1999, reports as follows:
Communication No. 211 recommends the appointment of the following individual to the Hawaii
County Planning Commission to serve a term ending December 31, 2003:
Ms. Florence S. Kubota, a Democrat, will replace Kevin M. Balog, whose term expired
on December 31, 1998.
Ms. Kubota, a lifetime resident of Hawaii, has been retired since 1989, after serving thirty
years as an educator with the State of Hawaii Department of Education.
Pursuant to Section 5-4.3 of the Hawaii County Charter, the mayor shall appoint members of the
Planning Commission to be confirmed by the Council, as prescribed in Section 13-4 of the
Hawaii County Charter.
In response to questions from Your Committee, Ms. Kubota explained that she believes any land
owner has the right to develop their land, but first needs to consider the impact on the
environment, the community needs, and cultural and governmental needs. She also explained
that if confirmed to the Planning Commission, she will consider all variables before rendering
any decisions.
In support of her nomination, Committee Member Aazon Chung mentioned that he has known
her for some time since he worked for her husband after he graduated from law school, and that
she is a very "sensitive" person who will be fair in rendering decisions.
Vice Chair Curtis Tyler questioned the validity of the nomination in regard to the recent charter
amendments, which stipulates that members of the Commission have to represent each of the
nine council districts. When asked if we were in compliance with the amendments, Rudy
Legaspi mentioned that we will not be in total compliance until the year 2000, when the
overlapping terms expire.

Your Committee on Planning recommends the approval of the appointment of Ms. Florence S.
Kubota to the Hawaii County Planning Commission.
