Your Committee on Public Works and Parks and Recreation, to which was referred Bill 270,
Draft 5, reports as follows:
Bill No. 270 Draft 5, transmitted by Council Member Brittany Smart, via Communication
No. 128.113, dated December 6, 2011. The State Building Code Council has reviewed and
proposed the adoption of the 2006 International Building Code (IBC) with amendments. Repeals
Chapter 5 of the Hawai`i County Code (Building) and replaces it with a new Chapter 5.

Bill 270 was amended with Communication No. 128.114 and Communication 128.117 and
forwarded to Council. There was also some discussion that was presented in Your Committee
meeting today, from Gary Chock of the Structural Engineers Association of Hawai`i. Mr. Chock
expressed his concerns with some of the suggested amendments and offered a rationale for why
Hawai`i had to be identified in the "Windborne Debris" section. Department of Public Works
Director Warren H. W. Lee spoke on behalf of the communication and recommended leaving in
language suggested by Mr. Chock, to allow for the option of(not the requirement of) a"safe
room" in a partially open structure.

Your Committee on Public Works and Parks and Recreation is in accord with the purpose and
intent of Bill 270, Draft 5, as amended (to Draft 6), and recommends its passage on second
reading.
