SUBJECT: Proposed Amendments to Bill No. 270, Draft 6; An Ordinance Repealing Chapter 5 of the
Hawaii County Code, 1983 (2005 Edition, As Amended), To Be Replaced By A New Chapter
5, Relating To Building
Please see below proposed amendments to Bill No. 270, Draft 6. The proposed amendments are illustrated by
Ramseyer format with respect to the contents of Bill No. 270, Draft 6, and bolded for emphasis; material to be
deleted is bracketed and stricken, material to be added is underscored.
Section 5 -3, of Bill No. 270, Draft 6, is amended to read as follows:
"Section 5 -3. International Building Code adopted.
(a) The "International Building Code, 2006 Edition" as copyrighted and published in 2006 by the
International Code Council, Incorporated, as it is adopted and amended by Chapter 180 of Title 3, of
the Hawai'i Administrative Rules entitled "State Building Code" (the "HAR "), as such chapter may be
amended or superseded from time to time, (the "IBC ") is hereby adopted by reference as set forth in
this chapter, subject to the amendments set forth in article 3 and article 4 of this chapter. Copies of the
"International Building Code, 2006 Edition" and amendments thereto shall be available for public
inspection at the department of public works and the office of the county clerk.
(b) [The-entire] Chapter 1 of the IBC, relating to Administration, is hereby excluded from adoption and
shall be of no force or effect[:], with the exception of:
a) Section 104.9 (Approved materials and equipment);
L21 Section 104.10 (Modifications); and
131 Section 104.11 (Alternative materials, design and methods of construction and equipment).
(c) The appendices to the IBC shall not apply unless specifically adopted by Chapter 180 of the Hawai'i
Administrative Rules or by this chapter, as provided in article 4 of this chapter.
(1) Appendices of the IBC adopted, as provided in article 4, division 1 of this chapter:
(A) Appendix C, Group U- Agricultural Buildings; and
(B) Appendix I, Patio Covers.

(2) Appendices added to the IBC, as provided in article 4, division 2 of this chapter:
(A) Appendix L, Factory-Built Housing;
(B) Appendix M, Thatch Material on Exterior of Buildings - Protection Against Exposure Fires;
(C) Appendix U, Hawai'i Hurricane Sheltering Provisions for New Construction;
(D) Appendix W, Hawaii Wind Design Provisions or New Constructions; and
(E) Appendix X, Indigenous Hawaiian Architecture Structures."
No draft copy of Bill No. 270, Draft 7, is attached in an effort to conserve resources.
