Dear Councilman Hoffmann:
Resolution 202 -11 was postponed on December 21, 2011 after waiver through Finance Committee was
granted. The intent of the waiver was to expedite the process of presenting the new Resolution before full
Council in order to move forward with a new contract to discontinue additional contract extensions. Prior
to this, the Department of Environmental Management (DEM) had dedicated time and consideration in
addressing the recommendations set forth in the October 12, 2011 Recycling Report (Communication
212.6), and met with certain Council Members to hear out comments and concerns.
The County Council's purpose behind the postponement was to provide an opportunity for DEM and
potential bidders to meet and discuss ideas moving forward. The DEM estimates that there are at least
twenty -five (25) potential bidders that should be invited to do this fairly. As it stands, the average time for
procuring a contract is four (4) months. The DEM has extended the current contract to June 30, 2012 or
until a new contract is awarded, whichever occurs first. The Department believes that ongoing contract
extensions are not desired as they result in negative public perception that the County is favoring the
existing vendor and that the County is potentially passing up opportunities of better prices.
In view of the above, the Department would like to be up front and inform you ahead of time that
procurement of a one -year contract with option years has begun. I have discussed at length with staff
and feel that the current contract specifications are not unreasonable. We are considering operational
cost savings strategy such as requiring the use of compactors which will reduce the frequency of hauling
and thus reduce hauling costs.
Should the County Council decide to pass Resolution 202 -11 on January 20, 2012, the procurement
documents can be modified from a one -year contract to a three -year. The intent is to have a new contract
in place prior to June 30, 2012. Otherwise, we will proceed with a one -year contract and continue to work
with County Council on a multi -year contract in the future.
