Your Committee on Planning, to which was referred Comm. No. 450/Bill No.137, reports as
follows:
Bill No. 137, transmitted by Mayor William P. Kenoi, via Communication No. 450, dated
October 20, 2011, is an Ordinance amending the State Land Use boundaries maps for the County
of Hawai`i by changing the district classification from the agricultural to the urban district at
Honomu, South Hilo, Hawai`i, covered by Tax Map Key: 2-8-013:063 and 064. Also enclosed
was a favorable recommendation from the Windward Planning Commission Chair Zendo Kern.
The applicant, Peter Christopher, was not present.
Council Member Ford stated that in Comm. 450 the Department of Water and Department of
Land and Natural Resources were concerned about water availability issues and that the
Department of Transportation described this as "spot"type zoning. She also has concerns with
the water issue and the proposed number of units being allowed.
Planning Program Manager Daryn Arai stated that this Bill is to change the State Land District
Classification to Urban to be consistent with the Zoning Classification. He also stated that the
water concerns would be addressed with current rules and codes in place when the property is
subdivided. He disagreed with the Department of Transportation's statement that this is "spot"
type zoning and stated that the Department of Transportation puts that on almost every
application they review.
Council Member Ford stated that this property abuts `Akaka Falls Road in a mostly Urban area
and that the Agricultural Land Classification could be changed to Urban.
Committee Chair Hoffmann stated that this bill is not a zoning application but a district class
change. He asked Mr. Arai if additional Council action would be needed in order to subdivide.
Mr. Arai replied that the applicant could subdivide if the current zoning change request is passed
without further Council action.

Council Member Yagong stated that this property is in his district and he agrees that water might
be an issue but would be addressed when the property is subdivided and he supports this bill.
Your Committee on Planning is in accordance with the purpose and intent of Bill 137, and
recommends its passage on first reading.
