No. 524/Bill No.166 PLACE: Council Chambers Hilo, Hawai'i TIME: 11:25 a.m. Council Chair and Members Hawai`i County Council Hilo, Hawai`i 96720 Your Committee on Planning, to which was referred Comm. No. 524/Bill No.166, reports as follows: Bill No. 166, transmitted by Mayor William P. Kenoi, via Communication No. 524, dated December 21, 2011, is an Ordinance amending Ordinance No. 95-98 which amended section 25-8-22 (formerly referred to as Section 25-103) (Puna District Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawai`i County Code 1983 (2005 Edition), by changing the District Classification from Agricultural—20 Acres (A-20a) to Agricultural— 1 Acre (A-la) at Keaau, Puna, Hawaii, covered by Tax Map Key 1-6-003:010. Also enclosed were favorable recommendations from the Windward Planning Commission Chair Zendo Kern and from Planning Director Bobby Jean Leithead-Todd. The applicant Renaissance Development, LLC, Robert Yoneoka; and Planning Consultant Sidney Fuke, representing the applicant, were present in Hilo. Mr. Fuke stated that the property was originally planned for a 35 lot development with a visitor center complex but the final subdivision approval deadline had expired when the current applicant purchased the property in 2008. He further stated the applicant wants to proceed with the project with 35 lots, without the visitor center complex, and that the applicant agrees to the three additional conditions relating to Fair Share, Affordable Housing, and Connectivity. Council Member Ford verified that the visitor center complex would not be built. She asked if the applicant was willing to pay the water connection fees for each lot. She also inquired if the distance from the Humane Society and the County Transfer Station was sufficient in regards to possible odors. Mr. Fuke confirmed the applicant was willing to pay the water connection fees and estimated the distance between the property and the Humane Society and the County Transfer Station as one mile. He further stated that he has been on the property and never noticed any odor. Council Member Blas confirmed the distance as at least one mile. PC Rept. No.: 37 PC-37 Page 2 January 19, 2012 Council Member Yagong inquired about the ingress and egress to the property and if there was any negative feedback from the Planning Commission meeting. Mr. Fuke passed out a more detailed map to the Committee Members showing access to the Kea'au Bypass Road and stated that the only concern voiced at the Planning Commission meeting was regarding connectivity to Kea'au Ag Lots, which also addressed Council Member Ford concerning stub outs for future connectivity. Committee Chair Hoffmann stated that he would not support this bill due to the inclusion of a fair share clause which he feels is not a legal condition. Council Member Yagong referenced Section 3, Covenant E and asked if the 50-foot roadways would still be built and dedicated to the County of Hawai`i upon the Mayor's request. Council Member Ford stated that the applicant should be dedicating the roads not the property owners. Planning Program Manager Daryn Arai related that the roadways would need to be built to dedicable standards and the dedication would occur at subdivision approval. Council Member Ford reiterated that property owners should be notified but not involved in the road dedication, and she asked Mr. Arai to work with her office in drafting an amendment to address that issue. Mr. Arai agreed to assist in drafting an amendment before the next Council reading. Mr. Fuke stated the applicant's intent has always been to dedicate the roads to the County of Hawai`i.
