Your Committee on Planning, to which was referred Comm. No. 332/Bill No. 90, reports as
follows:
Bill No. 90, transmitted by Council Member Brenda J. Ford, via Communication No. 332, dated
September 6, 2011, is an Ordinance amending Chapter 25, Article 1 and Article 5 of the Hawai`i
County Code 1983 (2005 Edition, as amended), relating to Zoning district regulations for
Crematoriums, Funeral Homes, Funeral Services, and Mortuaries.
On September 20, 2011, Bill 90 was referred to the planning director and planning commissions
by Your Committee.
Council Member Ford stated that A Hui Hou Crematory and Funeral Home owners Penny and
Connie Brumbaugh had discussed with her the need for legislation to treat mortuaries and
crematoriums equally in permitting and to add funeral homes and funeral services as similar
services with the same regulations for use.
Ms. Penny Brumbaugh stated that crematoriums and mortuaries both embalm and preserve the
remains. She further stated that the final disposition for both mortuaries and crematoriums can be
to bury the remains and that both offer similar services.
Council Member Ford related that Comm. 332.1 has a chart that shows the inconsistencies in the
zoning codes between the crematoriums and mortuaries which Bill 90 corrects. She requested
that the Planning Committee support Bill 90.
Council Member Pilago stated that Comm. 332.2 shows favorable recommendations from both
the Windward and Leeward Planning Commissions and he supports Bill 90.

Your Committee on Planning is in accordance with the purpose and intent of Bill 90, and
recommends its passage on first reading.
