The third "Whereas" clause is amended to clarify the purpose of the grant as follows:

Subject: Proposed Amendment to Resolution No. 220 -12, A Resolution
Transferring /Appropriating an Appropriation Out and From the Designated Fund
Account(s) and Crediting Same to a Designated Fund Account(s) for the Food Basket,
Inc.
Please see below proposed amendments to Resolution No. 220 -12. The proposed amendments
are inserted at the request of Corporation Counsel and are illustrated below in Ramseyer format;
material to be repealed is bracketed and stricken, material to be added is underscored.
A new first "Whereas" clause is inserted to indicate the section of the Code which allows for a
grant to a nonprofit agency as follows:
"WHEREAS, Chapter 2, Article 25, Section 2- 139(a)(3)(A) of the Hawai`i County Code
(2005 Edition as amended) states, "Grants in excess of $25,000 to nonprofit organizations shall
specifically identify the organization receiving the grant and the purpose for which the grant
shall be used in an ordinance or resolution;" and"
"WHEREAS, a substantial contribution to the Food Basket[, serving as Hawai`i Island's
Food Bank,] would permit this organization to purchase and/or to use as matching funds to
purchase food supplies [significantly increase its food supplies and provide for a three to four

A RESOLUTION TRANSFERRING /APPROPRIATING AN APPROPRIATION OUT
AND FROM THE DESIGNATED FUND ACCOUNT(S) AND CREDITING SAME TO A
DESIGNATED FUND ACCOUNT(S) FOR THE FOOD BASKET, INC.
WHEREAS, Chapter 2, Article 25, Section 2- 139(a)(3)(A) of the Hawai`i County Code
(2005 Edition as amended) states, "Grants in excess of $25,000 to nonprofit organizations shall
specifically identify the organization receiving the grant and the purpose for which the grant
shall be used in an ordinance or resolution "; and
WHEREAS, the Food Basket, Inc., serving as Hawai`i Island's Food Bank, (hereinafter
"Food Basket ") is an island -wide non - profit food network that collects and distributes nutritious
food to low income families, the ill and disabled, senior citizens, children's programs and other
charitable non - profit organizations; and
WHEREAS, a substantial contribution to the Food Basket would permit this
organization to purchase and/or to use as matching funds to purchase food supplies; and
WHEREAS, the Hawai`i County Clerk stated at the Special Finance Committee Meeting
held on March 30, 2011, "we've asked for the grant and we've not yet heard back, provided that
we receive the grant from Na Leo, we would not need to budget for that item;" and
WHEREAS, the Hawai`i County Council had budgeted for Fiscal Year 2011 -2012 for
the purpose of videotaping an amount of $120,220 prior to receiving notification of the Na Leo
`O Hawai`i grant; and
WHEREAS, the Hawai`i County Council has received a grant from Na Leo `O Hawai`i
in the amount of $75,000 to fund the production costs for the videotaping of Council meetings
for the period of July 1, 2011 through June 30, 2012; and
WHEREAS, on December 21, 2011, the Hawai`i County Council adopted Resolution
No. 198 -12, Draft 2 which strongly urged the Mayor to allocate not less than $500,000 from the
2011 -2012 operating budget immediately for the Food Basket to address a dire need; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
following amount is hereby transferred/appropriated as set forth below:

BE IT FURTHER RESOLVED that it authorizes the Council Chair and the County
Clerk to transfer $75,000 from Account Number 010.101.5101.02 (Clerk - Council Svc OCE) to
Account Number 010.101.5101.32 (Food Basket, Inc.) for the purpose of making a contribution
to the Food Basket, Inc.
BE IT FINALLY RESOLVED that the County Clerk shall forward copies of this
resolution to the Honorable William P. Kenoi, Mayor, County of Hawai`i and the Executive
Director of The Food Basket, Inc., Hawai`i Island's Food Bank.
