Ferreira Deputy Police Chief In compliance with the semi - annual reporting requirement of Chapter 14, Article 16, Section 14 -102 (2) of the Hawai'i County Code, the following island -wide statistics have been compiled for the period beginning May 1, 2009 through October 31, 2009. A total of 230 persons were arrested for marijuana offenses under Hawai'i state law. These include the offenses ranging from commercial promotion of marijuana in the first degree to promoting a detrimental drug in the third degree. Collectively, these arrestees account for a total of 318 marijuana cases. Two citations were also issued during the same time period. In addition, a total of $17,314 in cash and two vehicles were seized for forfeiture. These figures do not make the distinction between: • Marijuana arrests that were incidental to or were a result of other criminal investigations; • Arrests stemming from the distribution of marijuana; • Bench Warrants, Grand Jury Indictments, Information Charging or Penal Summons arrests that were the result of those investigations initiated prior to effective date of the Ordinance; • Arrests for marijuana offenses that had occurred on public property. This report does not include any arrests of, or citations issued to anyone under the age of 21. The Hawaii Police Department (HPD) was assisted by federal and other county law enforcement officers with eradication missions conducted during this time period. The department received a total of 28 helicopter noise complaints during these field operations, which were previously documented and submitted to the County Council as required. As indicated in our first semi - annual reporting memorandum, the HPD does not possess the ability to breakdown with absolute certainty the specific amount of time and money expended by the County of Hawai' i on the enforcement and punishment of marijuana offenses. However, HPD attempts to provide you with an estimate based upon an average time /cost factor. Future memorandums relating to the Lowest Law Enforcement Priority of Cannabis Statistics will use the same methodology. Estimates of Time and Money expended by HPD For the time period of May 1, 2009 through October 31, 2009, there were approximately 91,811 calls for service. Of those 91,811 calls for service, approximately 318 were related to enforcement for all marijuana offenses. Thus, for the time period specified, 0.35% of the calls for service were related to enforcement of adult cannabis offenses. This figure represents grant funding which amounts to approximately $20,973 of current salaries and overtime of personnel or 0.357159500% of the HPD's total budget and 0.35% or 0.342724400% of the Total Expended budget during this reporting period. It is important to note the following as it relates to the computation of the estimates contained within this addendum: 1. These estimates only cover the time period from May 1, 2009 to October 31, 2009. 2. These estimates are inclusive of ALL cannabis offenses of individuals, to include those below 21 years of age; which extends beyond the provisions delineated in the Lowest Law Enforcement Priority of Cannabis. 3. These estimates include cannabis offenses that were incidental to other felony or misdemeanor offenses /charges and excluded from the provisions of the Lowest Law Enforcement Priority of Cannabis. Our records indicate that during the aforementioned time period, a total of (197) persons were arrested and (2) penal summonses (citations) were issued for marijuana offenses under Hawai'i state law. These include the offenses ranging from commercial promotion of marijuana in the first degree (offenses outside the scope of the County Ordinance) to promoting a detrimental drug in the third degree. Collectively, these arrestees account for a total of (291) marijuana cases. These statistics do not include or reflect any arrests of, or summons issued to anyone under the age of 21. During this time period, a total of $13,811 in cash and one vehicle were seized for forfeiture. The following figures are inclusive of: • Marijuana arrests that were incidental to or were a result of other criminal investigations; • Arrests stemming from the distribution of marijuana; • Bench Warrants, Grand Jury Indictments, Information Charging or Penal Summons arrests that were the result of those investigations initiated prior to November 4, 2008; • Arrests for marijuana offenses that had occurred on public property. In March 2009, Hawai'i Police personnel assisted the federal government with an eradication mission in the County of Hawaii that was conducted by the Drug Enforcement Administration. The department has no statistical data on the number of helicopter over -flight complaints as these complaints were addressed by the DEA. The department currently does not keep statistics of the time and money expended by the County on the enforcement and punishment of marijuana offenses.
