On or about January 25, 2012, Corporation Counsel Lincoln S.T. Ashida, transmitted for the Council's
consideration, Communication No. 556 entitled "Claim Filed On Behalf of Glen Shikuma and Patricia
Nakamoto; Request to Hire Special Counsel." This matter was placed on the Council meeting agenda for
February 1, 2012.

1 intend to withdraw this matter from the agenda for February 1, 2012. This matter will be placed on a future
agenda at a later date pursuant to our Council Rules of Procedure.
The Office of Information Practice was consulted, and we were advised that the proper procedure would be to
withdraw this matter at the very beginning of the meeting, and before public testimony is taken, and that an
announcement be made that Communication No. 556 will be withdrawn from the February 1, 2012 agenda.
On behalf of the Legislative Branch of the County of Hawaii, the Office of the County Clerk this week has
contracted attorneys Michael J. Matsukawa, Esq. and the law firm of O'Conner Playdon & Guben for
professional services to assist with legal matters relating to the aforementioned Communication No. 556. As
this matter was rushed for placement for the agenda for February 1, 2012, the attorneys retained this week by
the Office of the County Clerk have not been afforded an opportunity to discuss the legal matters concerning
Communication No. 556 with the Office of the Corporation Counsel and given the short notice they are not able
to discuss these matters with you today.
1 have recently received important information from these attorneys relevant to the matters discussed in
Communication No. 556 and this information should be discussed with the Corporation Counsel and you at
future meetings and prior to your making any decisions concerning Communication No. 556. These highly
distinguished attorneys are arguably the best in their field in their respective areas of practice and will be able to
fully and completely discuss with you their legal advice and counsel concerning the matters relating to
Communication No. 556 at a future meeting.
1 understand that the Office of the Corporation Counsel has stated that time is of the essence with respect to the
discussion of Communication No. 556 and they have respectfully requested that this matter be rushed onto the
agenda for February 1, 2012. However, as this Council holds regular meetings twice each month, 1 am advised
that this matter may be withdrawn at this time, with no harm to the County.
