The amendments are illustrated below by Ramseyer format; material to be deleted is bracketed and stricken through, material to be added is underscored. 1. The 6th WHEREAS clause is amended to read: "WHEREAS, the Research Corporation of the University of Hawai`i (hereinafter referred to as "RCUH "), through Dr. Alton M. Okinaka, PhD, Director of the Social Sciences Training and Research Laboratory, is familiar with these types of reports and will conduct a study of the DAT program to measure its effectiveness; and" 2. The 7th WHEREAS clause is amended to read: "WHEREAS, a Memorandum of Understanding (see attached) is needed between RCUH and the County of Hawai`i to accomplish and fund this study which would evaluate the effectiveness of the DAT Program through interviews, surveys of coaches, athletic directors, teachers, students and parents of schools with DAT programs, the analysis of the results and a written report on the effectiveness of DAT as a reduction tool; and" Serving the Interests of the People of Our Island Hawai`i County Is An Equal Opportunity Provider And Employer Comm No. / 9' ` Ref. PH /dh att RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE RESEARCH CORPORATION OF THE UNIVERSITY OF HAWAII WITH RESPECT TO AN EVALUATION OF THE DRUG, ALCOHOL AND TOBACCO PREVENTION PROGRAM. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: WHEREAS, the federal Substance Abuse and Mental Health Services Administration's ( "SAMHSA ") Strategic Prevention Framework ( "SPF ") is a program designed to promote youth development, reduce risk - taking behaviors, build assets and resilience, and prevent problem behaviors across the person's life span; and WHEREAS, to accomplish its goals SPF has funded the State Incentive Grant program which has been the funding source for the County of Hawai`i's Drug, Alcohol and Tobacco prevention program ( "DAT ") administered through the County of Hawai`i Department of Liquor Control; and WHEREAS, part of the DAT program teaches student - athletes to be instructors, role models and mentors to other students on not only the dangers of drugs, alcohol and tobacco but the positives of living a drug, alcohol and tobacco free life; and WHEREAS, this program has been in existence for several years and it is commonly felt that this program is beneficial, but there has never been an empirical study of the effectiveness of this program; and WHEREAS, the grant requires that an evaluation of the program be conducted to validate the program's effectiveness; and WHEREAS, the Research Corporation of the University of Hawai`i (hereinafter referred to as "RCUH "), through Dr. Alton M. Okinaka, PhD, Director of the Social Sciences Training and Research Laboratory, is familiar with these types of reports and will conduct a study of the DAT program to measure its effectiveness; and WHEREAS, a Memorandum of Understanding (see attached) is needed between RCUH and the County of Hawai`i to accomplish and fund this study which would evaluate the effectiveness of the DAT Program through interviews, surveys of coaches, athletic directors, teachers, students and parents of schools with DAT programs, the analysis of the results and a written report on the effectiveness of DAT as a reduction tool; and WHEREAS, pursuant to Section 46 -7, Hawai`i Revised Statutes, this Council's consent is required for the Mayor to enter into a Memorandum of Understanding. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it does hereby consent to and authorize the Mayor, pursuant to Section 46 -7, Hawai`i Revised Statutes, to enter into the Memorandum of Understanding with the Research Corporation of the University of Hawai`i. Dated at , Hawai`i, this day of , 2012. 2 MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF HAWAII AND THE RESEARCH CORPORATION OF THE UNIVERSITY OF HAWAII This Memorandum of Understanding ( "MOU ") is entered into by and between the County of Hawaii ( "COH "); and the Research Corporation.' of the University of Hawai`i, hereinafter referred to as "RCUH." The purpose of this MOU is to designate the responsibilities and relationships between COH and RCUH ( "Parties ") regarding the evaluation of the Drug' Alcohol and Tobacco prevention program ("DAr'). The DAT program has been in existence for several years and it is commonly felt that this program is beneficial, but there has never been an empirical study of the effectiveness of this program. • Scope The scope is for the evaluation of the effectiveness of the DAT program's use of student - athletes as instructors, role models and mentors to other students through a sociologic scientific method. ' To be included in this study shall be surveys and personal interviews with coaches, athletic directors, teachers and parents of DAT participating schools and non - participating schools. The period to be evaluated shall include March 2011 to January 2012. The final report shall be completed and delivered to the County of Hawaii Department of Liquor Control on or before March 15, 2012. Other deliverables shall include: a. Develop an assessment protocol b. Develop an evaluation tool c. Conduct evaluation using tool d. Analyze results e. Submit a written report on analysis. 1❑ Assignment Evaluation shall be conducted by and under the direction of Dr. Alton M. Okinaka, PhD and his designees. No Assignment of this work shall be made without the written permission of COH. Ownership RCUH's information, products and data provided under this MOU are to be used by COH. COH may share these products with appropriate agencies and partnerships as necessary Such use does not constitute a transfer of ownership. No Warranty RCUH makes no warranties, express or implied, as to any matter whatsoever, including; without limitation, any invention. process or product,, whether tangible or intangible, conceived; discovered, or developed under this MOU; or the ownership;. merchantability or fitness for a particular purpose of any such invention or product. Liability RCUH shall not be liable for any direct,. consequential, or. other damages suffered by COH, or user, or any others including, but not limited to, damages arising from the model outputs, associated accuracies or precision, and/or subsequent usage/decisions by users. COH shall not be liable for any action of RCUH in conducting or reporting of this study. This Memorandum of Understanding will take effect as of the date of the last signatory to this document and` shall remain in effect for a period of one year. This Memorandum of Understanding can be terminated at the request of either party.
