Subject: Bill 98
Mr. Chair and Members of the Council:
Aloha, my name is Lee McIntosh. I encourage the Council to amend Bill
98 to exempt vehicles that are stolen. Owners of stolen vehicles should be treated as
victims, not accomplices.
Subsections (3) and (4) should also be amended to only apply to the offender's vehicle.
Owners should not be penalized for the actions of others. I am certain that they would
not lend their vehicle if they knew beforehand that the offender will go get drunk.
The purpose of the law is to punish infractions, not to prevent or
influence future actions. The punishment should match the offense.
Creating stiffer penalties will not change people's behavior.
Rather, the Council should consider banning the sale of alcoholic drinks in eating
establishments. Alcoholic beverages should be consumed at home, where the individual will
not have to travel. Buses and taxies are not always readily available here on the Big
Island as alternative transportation.
I hope that the Council will recognize that Bill 98 still needs more work before being
passed. Thank you for the opportunity to testify on Bill 98.
