Yamashiro per Communication No. 24, dated December 8, 1998, regarding the request by Waiakea Development to amend the change of zone Ordinance No. 92-51, at Waiakea, South Hilo, Hawaii, TMK: 2-4-37:36 (formerly 2-4-37:Portion of 16), reports as follows: Bill No. 8 amends Ordinance No. 92-51, which reclassified lands from an Agricultural (A-3a) to Residential (RS-10) zoned district for approximately 10.023 acres of land. Originally agendized on March 5, 1999, Bill No. 8 was deferred until March 16, 1999, so the Planning Committee could concentrate on the Zoning Code workshop which was also agendized on March 5. At the March 16, 1999, Planning Committee meeting, the applicant's representative was asked to explain the development plans for himself and his partners since the original plans established under Ordinance 92-51 were being amended. The applicants asked for a deferral of the conditions due to present economic conditions, and revised their original plans from developing a 32-lot subdivision to a 3-lot subdivision on Kupulau Road. Each of the three partners would be entitled to a lot, so Your Committee questioned Mr. Stanley Morikawa as to what the individual plans were. When Mr. Morikawa could not explain the intent of his partners, Your Committee asked to defer this measure until such time that the intent was known. On May 27, 1992, the County Council approved Ordinance No. 92-51 to reclassify a 10.023 acre portion of the subject parcel from A-3a to an RS-10 zoned district. On March 12, 1991, the applicants secured Final Subdivision Approval to subdivide out a 3-acre portion (A-3a) of the subject property that was not included in the approved zoning reclassification. On June 19, 1992, the Planning Department received the application fora 32-lot subdivision with approximate lot sizes of 10,000 square feet. On July 27, 1993, the applicants submitted revised preliminary maps fora 3-lot subdivision. Revised tentative approval was issued by the Planning Director on July 30, 1998. With this change of zone amendment, the applicants are requesting amendments to Condition C, E, F and H of Ordinance No. 92-51 with reasons that present economic conditions make it impossible to create a viable 32-lot subdivision project as originally planned. Based on the PC-37 PC-37 Page 2 July 7, 1999 reduced size of the development from the original 32-lot subdivision, the applicants are requesting additional time to secure Final Subdivision Approval (Condition C); deferral of roadway and drainage improvements to Kupulau Road (Condition E and F); and deferral of a housing plan for the development (Condition H). The 10.023 acres aze located on the east side of Kupulau Road approximately 410 feet north of its intersection with Ainaola Drive, in Waiakea Homesteads. To the east is the Waiakea Heights Subdivision, which consists of forty four 10,000 square foot lots. To the west on the opposite side of Kupulau Road are vacant parcels and single-family residential uses on lands zoned Agricultural (A-la, A-3a and A-l0a). To the north are pazcels zoned Agricultural (A-3a) and to the south is a portion of Waiakea Homesteads, consisting of lots averaging 7,500 square feet in size on lands zoned RS-7.5. The subject parcel is in Zone "X" which is outside the 500-year flood plain. Access to the property would be from Kupulau Road, a county road, which has a 16-foot wide pavement with 2-foot wide grass shoulders within a 30-foot right-of--way. There is a future 50- foot road widening setback established along the west (mauka) side of Kupulau Road. The eastern boundary of the parcel is connected to a stubout for extending Lelepua Street in Waiakea Heights Subdivision. Original wording in Condition E requires that the applicants provide a minimum 20-foot wide pavement to Kupulau Road fronting the subject property and extending to Ainaola Drive. Beyond the subject property, pavement widening would extend approximately 380 feet to Ainaola Drive. All essential utilities and services aze available to the subject property. Water is available to the subject property. Bill No. 8, Draft 2, which reformatted the original language of Ordinance No. 92-52 to our current format and replaced the housing language in Condition H with the standazd housing language, was approved by Your Committee. Mr. Morikawa stated that because times are hard, they want to divide the property into the three lots, so each paztner has a portion, and they want to dissolve the partnership. Committee Member Curtis Tyler asked if they would like to downzone the parcel, but was told that it may not be possible since one of the proposed parcels would be less than three acres. Mr. Tyler also wanted to insert the fair share conditions, but it was explained that since this is a previous zoning and the condition for an impact fee ordinance is included, we will not be amending that portion of the bill, as we have done in the past. PC-37 PC-37 Page 3 July7, 1999 Mr. Tyler also recommended that Condition I be amended to include the current language for restricting the construction of a second dwelling on a residential lot and Your Committee agreed. For informational purposes only, Committee Member Curtis Tyler and Julie Jacobson voted "Kanalua" twice on the final vote. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the amendment to Ordinance No. 92-51. Your Committee on Planning is in accord with the intent and purpose of Bill No. 8, Draft 2, as amended to Draft 3, and recommends it pass first reading.
