ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 1, OF THE HAWAII
COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO ALCOHOLIC
BEVERAGES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this measure is to allow the judiciary more
sentencing options of individuals who unlawfully drink alcoholic beverages in public
places. Many of these offenders suffer serious drinking problems and could benefit from
terms of probation that require substance abuse treatment, counseling or a geographic ban
from places where the illegal drinking occurs.
SECTION 2. Chapter 14, article 1, section 14-6, of the Hawai`i County Code 1983 (2005
Edition, as amended), is amended to read as follows:
"Section 14-6. Penalty.
[Any person violating any provision of this article or any condition set forth in a
--• • . . . -• . • . , upon conviction, be punished by a fine of not more
than $500.] A violation of this article shall constitute a petty misdemeanor. Any person
violating any provision of this article shall be guilty of a petty misdemeanor, and upon
conviction thereof, shall be punishable by a term of imprisonment of not more than thirty
days, a fine not to exceed $1000, or both."
SECTION 3. Severability. If any provision of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be severable.
SECTION 4. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 5. This ordinance shall take effect upon its approval.
