Yamashiro per Communication No. 344, dated June 21, 1999, regarding the change of zone request by Scott T. and Susan Fujie Shimabuku Nakahara, at Ouli, South Kohala, Hawaii, TMK: 6-2-9:10, reports as follows: Bill No. 96 amends Section 25-8-7 (North and South Kohala Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 5.588 acres of land from an Agricultural (A-Sa) to a Residential and Agricultural (RA-2a) zoned district. The undeveloped, rectangular shaped lot, owned in fee by the applicants, is located in the Kanehoa Subdivision on the south side of Ouli Street approximately 1,400 feet southeast of its intersection with Kawaihae Road. There are two access points off Kanehoa Drive that will accommodate the two proposed lots, one of which will be retained for their residence and the other for investment. The General Plan Land Use Pattern Allocation Guide (LUPAG) Map classifies the property as Extensive Agricultural which allow uses for pasturage and range lands. The County Zoning is Agricultural-5 acre (A-Sa). The property is not situated within the Special Management Area. The Kanehoa Subdivision is surrounded by the vacant State-owned lands to the south and zoned A-Sa; Kamuela Plantations, a 10-lot subdivision, located immediately to the east and zoned A-Sa; Anekona Estates Subdivision, a 36-lot subdivision, located to the west and zoned A-Sa; and Waimea Landmark Estates, a 26-lot subdivision, located across the Kawaihae Road to the northeast and zoned A-3a. These subdivisions include single-family residential and agricultural uses and vacant lands. The Agricultural Lands of Importance to the State of Hawaii (ALISH) System designation is "Unclassified". The Land Study Bureau's classification is "E" (Very Poor). The U. S. Soil Survey classifies the soils as Puu Pa extremely stony very fine sandy loam with moderately rapid permeability, medium runoff and moderate erosion hazard. These soils are used for pasture. PC-39 PC-39 Page 2 July 7, 1999 The subject property is located within Zone X, which is determined to be outside the 500-yeaz flood plain. No native fauna was observed on the site, and there are no known or recorded rare or endangered animal or plant life in the area. According to the applicants' environmental report, no historic or archaeological sites were present on the parcel. Because the property was previously graded and used for cattle grazing, the proposed action will not have any effect on significant historic sites; however, the condition to notify the Department of Land and Natural Resources-Historic Preservation Division should any archaeological sites be encountered, will be included. Access to the subject property is off Kanehoa Street, which has aright-of--way width of 50 feet with a 20-foot agricultural standard pavement. Water is provided by an existing 6-inch waterline that fronts the subject property. There is no municipal sewer system in the area, so individual wastewater treatment systems have to be installed. All other utilities or services aze or will be made available to the property. Bill No. 96, Draft 2, which included language to prohibit the construction of a second dwelling on the residential lots, was circulated and approved by Your Committee. Your Committee did not entertain any further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration to the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No 96, Draft 2 and recommends it pass first reading.
