Yamashiro per Communication No. 279, dated April 26, 1999, relating to subdivisions, reports as follows: Bill No. 78, amends Chapter 23 of the Hawaii County Code, as amended, relating to Subdivisions, by conforming it to the Hawaii County Charter amendments of Ordinance No. 98-83, which was approved by the voters on November 3, 1998, and became effective on Mazch 3, 1999, exactly one hundred twenty days after approval. Ordinance No. 98-83 amended Hawaii County Charter Section 5-4.2, relating to the Planning Director; Section 5-4.3, relating to the Planning Commission; and Section 5-6.3, relating to the Boazd of Appeals with the following changes: 1. The Planning Commission is eliminated from the appeals process. 2. The Planning Commission membership will be representative of each council district. 3. The Boazd of Appeals will heaz and determine appeals from the final decisions of the Planning Director and the Chief Engineer regarding matters within their respective jurisdiction, and to insure that no appeals from the Planning Commission aze heard and determined by the Boazd of Appeals. Bill No. 78 first surfaced at the May 26, 1999, Planning Committee only to be deferred to June 22, 1999, then July 7, 1999, and August 10, 1999 because of time constraints and questions regarding the deleted language. At today's meeting, Your Committee was assured that the deleted or amended language in Bill No. 78 was the same as in Ordinance No. 98-83. However, there was one proposed amendment "Any person appealing such a decision shall pay a nonrefundable fee of $250.", which was not part of the original ordinance, so Your Committee recommended that it be deleted to reflect the intent of the bill as stated in the title. PC-51 PC-51 Page 2 August 24, 1999 Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration on the proposed amendment to Chapter 23 of the Hawaii County Code. Your Committee on Planning is in accord with the intent and purpose of Bill No. 78, as amended to Bill No. 78, Draft 2, and recommends it pass first reading.
