ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, SECTION 24-256
OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO 30
MILE PER HOUR LIMIT.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this measure is to update the Hawai`i County Code to
match existing conditions to allow designation of a 20 mph speed limit for a portion of Government
Beach Road.
SECTION 2. Chapter 24, Article 10, Division 1, Section 24-256, Schedule 4. 30 mile per hour
limit, subsections (g)(2) and (g)(3) of the Hawai`i County Code 1983 (2005 Edition, as amended), is
amended to read as follows:
(2 ) Kalapana Government Beach Road, from a point 2.35 miles north of the Kapoho
Kumukahi intersection Pahoa-Kapoho Road to the Kaimu Pahoa Kapoho intersection
Papaya Farms Road.
(3) Kalapana-Kapoho Beach Road, from a point 2.35 miles south of the Kapoho Kumukahi
intersection to the National Park boundary.
SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In
printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be
included.
SECTION 4. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or application,
and to this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
